Eric Holder: The best place to try these cases is not subject to the whims of Khalid Sheik Mohammad.

Make no mistake - it’s not KSM that’s on trial,
it’s the Bush Administration.
Standard third world thugocracy tactics, putting your predecessors on trial and executing or exiling them.
He only pled guilty after he was tortured and was never Mirandized. Is this case going to be about whether the justice system should be relaxed when dealing with certain “criminals”?
If this guy is found “not guilty” they will surely bring him up on other charges. But I am not sure he can be convicted of breaking an American law unless there is actual evidence beyond the heresay of other terrorists that connects him to the planning of 9/11.
He actually has a strong defense in American courts. And this is the problem. I would like an answer to the question, “Why is it better for America to put this guy on trial in a federal court as apposed to a military court?”

I hope someone asked Holder why the mastermind of the attack on the U.S.S. Cole and some other guys are getting military tribunals, while KSM and some guys get a civilian trial. It makes no sense at all.

If KSM has already entered a plea at one federal forum and those charges were dismissed, then his lawyer will probably be screaming “Jeopardy has already attached” and “Double Jeopardy”
This isn’t going to turn out the way BHO expects. Oh we’ll convict him regardless of the rules, but it the defense will scream about every deviation from established rules and procedure and we will end up looking like we have run a Kangaroo Court.
This isn’t a legal proceeding, it’s theater. Political theater. Show trials are always political theater.
Well, to the liberals/ACLU/Obama, America is at fault because we haven’t always lived up to our highest ideals. So, we need to bend over backwards to prove to people like Bin Laden that our system of justice will deal fairly with terrorists.
Of course, there’s a whole body of international law behind having military tribunals for war crimes, but, the liberals think they are proving something about how superior they are by giving these guys a civilian trial.
Obama doesn't have the balls to try any Bush administration officials for their counter-terrorism activities. Plan B is a criminal trial of KSM that makes a record regarding his interrogation for the international left to use in prosecutions somewhere outside the US some day. George W. Bush and Dick Cheney had better stay close to home.
Obama and Holder are deliberately hurting America to make the left wingnuts happy. Coming right after the administration's criminal negligence led to the Fort Hood massacre this has to hurt them politically. They'll probably see it in their tracking polls and react.
I'm betting the KSM trial goes the way of the Gitmo shutdown. It will be astonishing if they can deal with the heat on this one.
And, like the “trial” of the ‘93 WTC bombers,
all of the names of our intelligence gathering field agents
will be hand delivered to Al Qaeda.

He was Mirandized when he got to Gitmo. He did his confessions AFTER being Mirandized in order to create a Martyr status.
Water Boarding was appropriate here — and certainly not “torture” of the type used when Daniel Pearl was beheaded.
Now, he has a better venue and soapbox than the Martyr gig. And the Obama Administration can use this to demonize the Bush Administration, the CIA, etc...
He should NOT be tried in a civilian court — should absolutely be tried in a military tribunal.
In a civilian court, a rookie defense attorney ought to be able to get this guy acquitted and in fact get him a multimillion dollar settlement from the feds.
KSM was not captured for the purposes of a civilian trial, he was captured by the military in wartime. There should be only one standard. Can he be released? No. Never? No. So you give him a thirty minute hearing to document the fact that he is, in fact, KSM, you document the reason you are going to hang him, you consider whether or not there is any further intel value to be extracted from him. And then you hang him.
Guilt or innocence in a normal civilian legal sense doesn’t enter into it. His fate was determined the day he declared war on us. This is a military matter.
