There are aspects of US law - famously, McCain-Feingold with its privilege for Associated Press journalism to criticize politicians while it presumes to deny that right to the people - which are predicated on (make no sense in the absence of) the assumption that Associated Press journalism is objective. It is easy to show that that assumption is absurd.
To me the issue of holding the promoters of that fallacy to book is of such moment as to make it, in practical terms, the only important issue. Without that fallacy, Democrat politicians would stand naked of defense for a multitude of sins - the Globalony fraud not least among them. Indeed, it would be interesting to conduct a contest on FR to try to call to mind all the frauds perpetrated by AP journalism. The list would include "Swift Boating" as a smear designed to insinuate that the Swift Boat veterans were proven to have lied about John Kerry's war record (see To Set the Record Straight). And it just seems to me that the correct mechanism for bringing AP journalism to book would be a civil lawsuit, preferably claiming treble damages under RICO.
