Nope. The limits are nothing but a legal line that requires prosecution. Below the limit still allows for prosecution. Heck, a mere 0.01% BAC could led to a DUI arrest and prosecution in DC. I don’t think it was a Judge or a Pol, but my memory is failing. Maybe Mr. Elk can help me remember.

I’ve related a story here before, told by a former Mass. State Trooper, that John Kerry was stopped for speeding by a young officer, Kerry lashed into him with obcenities along the lines of “How dare you stop me” and thereafter the young man’s career was ruined.

California is one of the few sates that any consumption of alcohol before driving can be, based upon the Officers determination that the person is impaired (IMPAIRED- (CA) Observed leaving a parking lot where there is located a popular cocktail lounge), an arrest for DUI and the reason for further tests, If then the person is found to be above the so called legal limit they can then have an additional charge of DWI in addition to the original arrest for DUI. If the person is below the legal limit they are released and charged with DUI only. Then at the discretion of the prosecutor it could be reduced to a so-called wet reckless driving, but would not normally be dismissed.
So now do you think that she got special treatment
