Attorneys for an anti-illegal immigration organization are challenging a Texas state law that allows illegal immigrant students to attend colleges and universities at in-state rates, saying it violates federal law. David A. Rogers, a lawyer for the Immigration Reform Coalition of Texas, an organization that opposes illegal immigration, said the lawsuit filed on Monday in Harris County District Court marks the first direct court challenge of the Texas law. Texas is one of 10 states in the nation that have laws offering in-state tuition to illegal immigrants who meet certain criteria, including graduating from a local high school and pledging to legalize their immigration status as soon as possible. The lawsuit specifically names the University of Houston, Houston Community College and Lone Star College systems. A spokesman for UH declined to comment on Tuesday, citing the pending litigation. HCC officials said a copy of the lawsuit was under review by their attorneys. A Lone Star spokesman said the college was not prepared to comment Tuesday afternoon.

What is wrong, is letting the illegals stay in violation of federal law. And then using their illegal status to make 2nd class citizens out of them.
It they are allowed to stay, are paying taxes, and meet the normal residency requirements they should be allowed in-state tuition.
How are they going to get a job, considering their ILLEGAL STATUS? At the expense of those waiting in line to come in? At the expense of citizens?
Maybe out of state students ought to just claim illegal immigrant status.
More importantly, illegals should not be in our country.
For that matter illegals shouldn't be sitting in the oval office.
The gay mayor in Houston is nothing compared to Senator Sheila Don't-You-Know-Who-I-Am Jackson Lee and Houston's latest contribution to the governor's race. Sadly, The Great State of Texas is no longer great.
Its a state law. Gov. Perry is a Republican. The city of Houston didn’t make the law.
As well they should be instead of giving them better rates we should give them a ride back across the border!

But don't tell them it's fine to stay but by the way, you have to pay more to educate your kids. I see biblical principles against that. The commands were to Israel, not to us, but they say much about where God's heart is in the matter.

Both illegals and out of state students still have to meet the normal residency requirements to qualify for in-state tuition, don't they? So there would be no advantage for an out of state student to claim illegal immigrant status.
In-State Tuition and Unauthorized Immigrant Students
In 1996, the illegal immigration reform law instituted a restriction on states' residency requirements and in-state tuition benefits for higher education, affecting an estimated 50,000-65,000 unauthorized immigrant students annually.
Ten states subsequently enacted legislation (2001-2006) to allow long-term unauthorized immigrant students to become eligible for in-state tuition if they meet certain requirements: California, Illinois, Kansas, Nebraska, New Mexico, New York, Oklahoma, Texas, Utah, and Washington. In 2008, Oklahoma ended its support for in-state tuition for students without lawful presence.
Congress has been considering bipartisan legislation to repeal this provision and help certain immigrant students gain legal status. In the 110th Congress, legislation in both the House and Senate was introduced with bipartisan cosponsorship....
It is a state law enacted by the Legislature in 2001. Perry signed it. It was written by Rep. Rick Noriega (D-Houston) (who ran against Cornyn in 2008). It has always been a bit unclear exactly where he was born. Ahem. Every member of the Legislature who voted for this legislation voted to favor the interests of illegals at the expense of Texas taxpayers.
