Can the SCOTUS review the constitutionality of a bill before it passes, or does it have to be passed and signed into law first?

I believe Fox News’ Judge Nepolitano said that you would have to have “standing,” which means you would have to be willing to risk going to jail and/or paying the hefty fine if you don’t buy insurance, and who is going to want to do that?

Hopefully, if the Republicans win in 2010, they can dismantle this crap sandwich.
