Obama's Nobel is unconstitutional (Cash prize not authorized by Congress)
World Net Daily ^ | 12-22-09 | Joseph Farah

Article I, Section 9, of the Constitution, known as the emolument clause, states: "And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Price or foreign State. …" Most Americans may not realize, as I did not until very recently, that the Nobel commission is elected by the parliament of Norway. That means the peace prize is made by a commission representing the legislature of a foreign state. There's little question the award amounts to an emolument – at nearly $1.5 million and a priceless gold medal.

Back in 1902, the U.S. attorney general

There is precedent for a sitting President receiving the Nobel Peace Prize. What was done before?

Its okay folks, the law only applies to American Presidents not Kenyans. Bammy can add it to his obamastash. You know, all he invests in are Tax Free Municipal Bonds. That was the stock tip of the year in 2009.

What’s the problem? I am sure that Congress would rubber-stamp any approvals needed.

The key point is: ..without the consent of the Congress.. Congress long ago made provisions for such awards in U.S. Code Title 5, Part III, Subpart F, Chapter 73, Subchapter IV, Section 7342.

What Farah should be worried about instead of this little joke of a prize is Zero's position as head of the UN security council.

Imagine the uproar if Newt got a Nobel while he was speaker. He’d still be in jail.

I thought I'd heard that Obama was donating the cash portion of the prize to some charity.

“I am sure that Congress would rubber-stamp any approvals needed.”

In THIS Congress, it is a ROBBER STAMP Approval...

I believe he gets avoids any inpropriety by donating his award to charity. I heard he was doing so.

Theodore Roosevelt was indeed awarded the Nobel Prize in 1906 while he was President, but he refused to accept the award until 1910 after he had left office.

But, Congress has already made provisions for the Nobel and other such prizes to be accepted by a sitting President (the prize itself and the medal become property of the U.S. Government and likely the medal will be returned to the White House after Obama’s death as a permanent article of history for the White House), so this is (once again) crying wolf over a non-issue.

To give the money away, he had to take possession. That is the issue.

Non-issue: I believe Obama gave the money away.

I heard the same.

However, one could argue that Obama didn't have the authority to decide what to do with the money -- Congress did.

So, instead of Obama donating the money to a "charity" like ACORN (I don't know where he donated the money), Congress might have authorized the acceptance of the award on the condition that it be deposited into the general fund in the Treasury instead.

There's no issue. As has been pointed out above, there are already provisions in law to deal with this.

Typical WND hyperventilation.
