If one of the birther cases ever does make it to the Supreme Court, you can bet they'll make noises about separation of powers, shake a stick at Article II, Section 4, and toss the hot potato over to Congress. No way will they take it upon themselves to remove a sitting president.

How can someone not eligible to *be* President, be a "sitting president"?
