Not guilty of ramming the dike ship .

Universal Law of the sea if under power. Least able to change course has the absolute right of way.

Excuse me? Seems clear enough that the Sea Shepherd was on a collision course with the Japanese boat.

There is another video of the same incident from ahead of the Japanese ship. The whaler definitely puts his rudder hard over into the Sea Shepard ship. The Sea Shepard was going for a close pass to throw stink bombs at the whaler, and the Japanese captain turned into him.

However since throwing glass bottles onto a crowded ships deck constitutes an assault I would say there is a good argument for self defense on the part of the Japanese.

Well, can't say I disagree with you, but until the Japanese get around to doing the job, Sea Shepherd once again self-inflicts damage on their vessels with their ramming of the Japanese ship.

I don't know, I think you'd need an element of lethality to call it attempted murder

Deliberately ramming a boat with the liklhood of knocking people into frigid water in the Antarctic is IMHO attempted murder.

If any of those guys had been knocked into the sea or hit by the hull of the whaling ship, they would likely have been killed. The captain of the whaling ship clearly had the intention of ramming that ship and killing those pesky whale lovers.

I suspect this will be the last expedition for that captain. Even if he is not criminally charged, he will not be given another ship to skipper.

Deliberately trying to foul a ships screw in the roaring 40s leaves them at the mercy of the waves. They could sink from that alone, or be damaged by the fouling cable. Attempted murder to try to damage or disable a ship at those latitudes.

The Japanese Navy needs to head south and protect their fleet. Time for a Japanese Navy night action.

Look at the latter part of the video on the jap ship, looking starboard aft - no sign of a stern wake - you only get that if the Jap ship had been making a sustained turn to port (away from the black boat).

Unless he argues that he was acting to defend his crew. Remember that the speedboat was throwing glass bottles of rancid butter onto his ship. You get hit in the head with a Snapple bottle you are going down for the count. If Somali pirates are trying to board your ship you have every right to try to capsize them as they come along side. Same law applies to the eco nuts. Once they started attacking, and a good lawyer will be able to argue that throwing bottles and attempting to board a ship constitutes an attack, they can defend themselves.

But yes the Japanese captain was trying to sink them in an environment where getting sunk means getting dead. The argument is if he was justified in doing so.

Are they not interfering with the free navigation and lawful commerce of the whaling vessel??

These enviro-whackos need to be greatful they were not fired upon and sent to Davy Jones Locker... post-haste.

If they want to bring the burden of their convictions to bear upon other vessels and by extension--other nations--
Then lobby and influence the powers-that-be to change the law--
And insist on even-handed enforcement of the law.

To intentionally place your craft of any size in the path of a another vessel is an attempt to exert your will upon that vessel and its mission--beyond insanity.

When you are picking such a fight on the high seas...
Best be ready for retaliation including being fired up on and/or sunk.

(The video clearly shows they were not "dead in the water" -- lying b*st*rds -- as well)

The Japanese video shows the eco-boat accelerating at the last moment to cause the collision.

You go around the world antagonizing people and then complain when you get your just deserts? I don't think so.

That stupid carbon fiber boat was throttling up big time when it got hit.. my guess is this, they figured they'd harass the Japanese, the bigger boat move close enough to spray them, they panicked gunned their engines thinking they were going to get hit, and ran themselves right into the ship.

Stupid idiots.

Yes, I don’t remember the precise rules, but I remember things like, a speed boat has to give a sailboat the right of way, and a sailboat has to give a rowboat the right of way. But a sailboat may want to stay out of the path of a ferry.

These guys look a little like they were playing with fire and got an owie.
