In "the never-ending race to protect our country, we have to stay one step ahead of a nimble adversary."
So instead of treating him as an Enemy Combatant the first thing we do is toss him the rights of US citizens, Mirandize him and get him a lawyer. THAT will certainly help us stay ahead of our nimble adversary.
