Could a recount in Massachusetts Senate race become the real 'delay'?

The Brown campaign has said if the GOP State Senator wins, the Democrats in the state will find a way to delay Mr. Brown's certification (more info here) before the Senate wraps up health care reform legislation and votes for its final passage. Mr. Brown has already said he would vote against the health care bill, while appointed Massachusetts interim Senator Paul Kirk (D - MA), who is currently keeping the seat warm until a new Massachusetts Senator is sworn in, vows to vote for its passage.

However, the race is currently so close, a recount could very well be triggered before any thoughts of certification or swearing in even happens come election night on January 19.

According to the General Laws of Massachusetts a recount can happen if the margin of victory is less than 0.5 percent.

Seems to me that if Scott Brown’s election would be considered the second shot heard ‘round the world, sufficient to scare the pants off conservative to moderate dems, that even his NEAR election or CONTESTED election should provoke the same reaction. And if that is the case, shouldn’t it provoke some vote changing on this hated bill to reflect that fear, such that even without this ONE VOTE it would not pass?

If Brown wins and the Dems trump something up to delay his seating, the entire GOP Senate delegation needs to walk out of the Capitol in protest every time a vote comes up on healthcare until Brown is seated.

If Brown wins by a few hundred or a couple of thousand, a recount is guaranFrankenteed and Senator Coakly will be in DC by the end of the month.

Brown will have to win by at least 5% to ensure there is no recount. I have been placing calls on behalf of Brown. He will win by a wide margin if my unofficial tally is any indication.

This brings up a point that I’ve said several times in conversation but I don’t think I’ve posted here...

The Democrats are pushing for the health care bill *knowing* it is unpopular. *knowing* that their reelection will be more difficult or even impossible due to their votes. Why? Because they have an agenda that they are determined to pass and willing to sacrifice for. They have an ideology that is more important to them than whether or not they remain in power. They are determined to do what they can with their super-majority, knowing it is only temporary.

Just imagine how much different our lives and our countries could have been if the Republicans in 2000 and 2004 had had such a strong passion about — well, anything really.

The way to reverse course is not to elect whoever happens to have an “R” after their name. The way to reverse course is to elect people who are as feverent about conservative and libertarian principles as the democrats are about socialist principles.

Yes, Kirk still votes. Makes no sense to me... seems to me that starting on 1/20, the senate should be minus one senator and then remain that way until swearing-in. Otherwise, where is there any incentive to swear-in?

Just to be inclusive of info in posts yesterday:

Teddy was elected in a special election on Nov 6, 1962. He was sworn in within 24 hours by LBJ on Nov 7, 1962. Unless its a hair, if Scott wins I'd expect no less.

Talking to FR friends more knowledge-able about this than I, and they tell me the following.

Any judge in good standing (he mentioned Federal Circuit Court) coudl sign Scott in.

I think a Military Judge signing him in would be delicious, Go ahead Harry say he isn't legit if he does...

What say you legal eagle Freepers?

BTW, IMHO if they delay it and try some $&!+ I am hearing on talk radio and elsewhere they think people are pissed now, just see how angry and how they protest if they try this crap.

If Scott Brown wins by less than 10,000 votes, the ‘rats will “Franken” him.

He’ll never be seated, and Croakly will ascend to “Teddy’s seat” in 9 or 10 months.

Kirk’s term ends when the vote is certified. Until Galvin certifies the election, Kirk can do what he wants. In ANY event, Galvin can hold up the certification for up to ten days to ensure that the absentee ballots are counted.

Of course, there is nothing else on the ballot, and in our town the absentee ballots are run through the machines that day...so i am not sure why they would need to wait.

When Tsongas won her Congressional seat, she was sworn in days, not weeks.

When they want to move, they can move fast.
