Sheriff Accused of Violating Immigrant's Rights

Butler County Sheriff Richard K. Jones was in federal court Tuesday, facing charges he violated an illegal immigrant's constitutional rights.

Our partners at the Journal News report the charges stem from a lawsuit filed after a 2007 incident when Luis Rodriguez and others were rounded up at a construction site on Port Union Road by Butler County deputies and a former immigration specialist hired by Jones, according to reports.

Officials said they were at the site to talk to a supervisor about undocumented workers, but while there Rodriguez and others were interrogated and asked to provide identification, said Rodriguez's attorney, Al Gerhardstein. Gerhardstein said his client, who had lived in Butler County for 11 years, was arrested and charged with providing a false identification and was deported to Mexico, though he was later acquitted of the charge.

Rodriguez' children, including two born in the United States, returned to Mexico, too, to keep the family together.

The court will decide if Jones authorized deputies and the former ICE agent to arrest Rodriguez and whether he had the right to do so, according to reports. Gerhardstein contends that Jones doesn't have that authority and that Rodriguez's fourth and fourteenth amendment rights were violated. The fourth amendment guards against unreasonable search and seizure, and the 14th amendment guarantees the right to due process and equal protection to all people within the U.S.

Rodriguez is seeking damages and also trying to establish the principle that there aren't any exceptions to the Fourth or 14th amendments.

A judge will decide in the next few weeks whether the lawsuit can continue.

Keep in mind as you read this article, that our court system is being destroyed because illegal aliens are given rights, and sometimes more rights, than US Citizens. Sure would be a lot cheaper to just keep them OUT!

Illegal immigrants? Aint no such thing under law. They are illegal aliens, and as such do not have any constitutional rights.

Im sorry to say this but its the truth we are about to collapse,America has so many enemies and they are curently winning. Many anchor babies identify themselves as Mexicans and some are voting for the democrats who allow this garbage to continue.

Looks like a frivolous suit. Law enforcement had "probable cause" to enforce the law.

Since when did a Sheriff, a duly-sworn law enforcement officer, not have the right to tell his deputies to arrest someone?

I invade your country.

I parade in your streets openly, making mockery of your 1st Amendment. I even vote in your elections under fictitious names that I assumed when I invaded your country, which BTW, is really my land that you stole through deceit. I can form special interest groups that by there very name and nature are racist, but will exercise my right to redress with the government if you form one to oppose me.

I commit crimes in your country and have the same reasonable expectations of privacy and to be free from unreasonable governmental intrusions under your 4th Amendment.

I have the right not to incriminate myself but make your government do it under the 5th Amendment.

I make you provide me competent legal counsel on your taxpayers dime under your 6th Amendment. Remember, I am indigent despite supposedly working those jobs you so called “Real Americans” won’t work. Plus I have the Consul to provide me with legal defense as well.

I can rape your children and not expect to be punished too harshly because of your 8th Amendment. Furthermore, I make you prove that I am not a natural born citizen so that you can’t throw me out until you prove that I am here illegally.

Under your 13th Amendment I am free from indentured servitude but I don’t have a problem with selling some of my own people into slavery. Sometimes I sell some of yours, especially if they are pretty.

I make full use of the 14th Amendment so that I have the same rights of due process as you “real Americans”.

So, all these rights are afforded to me. A reasonable invader, excuse me, immigrant, would feel free to exercise the 2nd. After all, don’t you say that the 2nd Amendment has no restrictions? Would you all very much mind if I gather a bunch of my compadres with tattoos on their faces and exercise our right to form militias?

Before anyone goes completely apoplectic, this is sarcastic in nature but the truths are self evident, so to speak.

Aren't illegal undocumented aliens technically just invaders of our nation, who apparently the CIC's refuse to counter?

I mean there is a clearly established formal way for any foreign citizen to enter the United States is there not? Like applying at the consulate in one's home nation?

Isn't that the international standard?

Can I just go into Mexico without formal clearance and start working there while using the schools, hospitals, etc?

Can I just go into Canada without formal clearance and start working there while using the schools, hospitals, etc?

And that is simply speaking of North American neighboring nations. Can a Polish citizen just enter the United States without clearance and start working and drawing on the public benefits? And if not why is he discriminated against versus Mexican insurgents.

What is going on here? Where is Hillary Clinton, Secretary of State, or Gates, Secretary of Defense?

Is there a United States with a taxpaying, law abiding, citizenry who are taxed and obligated to be defended, or is there just international anarchy?

Are we not talking obvious issues here?
