Back in the 60's and 70's the Chicago Police Dept had the infamous 'Red Squad' who in conjunction with the FBI *spied* on US Citizens who protested anything from Civil Rights to Vietnam.After years of legal wrangling in Federal Court a Consent Decree was finally reached between the plaintiffs and the CPD & FBI. One conclusion and condition reached was, 'No Monetary Damages'.
The CPD & FBI have to still operate under this Consent Decree. That's one reason why Illegals can march and protest so openly, the CPD & FBI can't even video tape them. It follows that any LE org, even the new DHS are or would be under the same restrictions. So this group can get access to any and all files -- that was also part of the Decree -- but zero dollars for 'damages' for First Amendment violations.
The CPD 'Red Squad' Court Battle was the 1st thing I thought of when seeing this, so I was back refreshing my memory through Bing.
