The Constitution provides that the Executive shall, Patterson can't leave the seat vacant until the next election rolls around. There's very little leeway, I suppose Patterson could put it off until a health care reform vote is scheduled, but open until August, worse, November? No.

They said on Fox News this morning that it is up to Patterson. I hope they are wrong but maybe he can just say wait till November. I saw something else over the weekend that he has 30 to 40 days to set a date but not sure if the date has to be before November or not.
I don't know enough about it and since when does a Constitution matter to a democrat?
