'Very Troubling': Chief Justice on Obama's Court Criticism to Joint Session of Congress
The Los Angeles Times ^ | Tuesday, March 9, 2010 | Andrew Malcolm

Posted on 03/09/2010 6:36:44 PM PST by kristinn

Some firm and unequivocal pushback today by Supreme Court Chief Justice John G. Roberts Jr. to President Obama's court criticism in January.

It is not at all unusual in American history for the executive branch of the federal government (the White House, under the control of either party) to disagree with the judicial branch (Supreme Court).

What is considerably more unusual is for the chief executive of the executive branch (Barack Obama) to look down on the members of said Supreme Court in public at a joint session of Congress and to their faces denounce their independent actions.

And then to receive a resounding ovation from fellow Democrats standing to applaud and cheer Obama as the surrounded justices sat mute, motionless and unable to respond.

That, of course, is what Obama did in his first State of the Union address Jan. 27, objecting to a court decision allowing corporations to donate political funds like individuals as a matter of free speech.

SNIP

Speaking in response to a law student's question, Roberts said anyone could criticize the court and, indeed, our governmental system of separation of powers encourages such opinionated diversity. Then, the chief justice added:

"I have no problems with that. On the other hand, there is the issue of the setting, the circumstances and the decorum.

"The image of having the members of one branch of government standing up, literally surrounding the Supreme Court, cheering and hollering while the court — according to the requirements of protocol — has to sit there expressionless, I think is very troubling."

Well, Chief Justice Roberts, maybe you can get a look at the birth certificate. Please make sure it is the original, long-form document. That would be a good place to start addressing the question of whether or not Obama is constitutionally qualified for office, and other documents might require your examination as well...

Sotomayer may be the only one that shows up for the next STOU address.
I’d find it amusing if Obama did something to upset her and put her at-odds with him.

I watched her face at the SOTU when he was lecturing them. She did not look like a happy camper AT ALL.

I saw a woman slobbering on herself during a nap, who woke up for a second to frown.

Maybe I should look at the video again.

The first presidential candidate who promises to dump the whole silly ritual and go back to just mailing in a written SOTU to Congress, the way Thomas Jefferson did, will get my vote for sure. Although I have to admit that I loved watching Dubya smirk at the Dems when they'd behave badly during his SOTU addresses.

Not as troubling as watching *you* swear in this Marxist usurper.

The power of group prayer is very strong...it works and at a time and in a way we may least expect. My nightly prayer list is a long one these days...

I don’t believe this has ever happened in our lifetime, and likely never in the last century or even if ever

Hi Starwise. Good to chat with you again. Franklin Roosevelt, another Leftist Dem president, tried to pack the Supreme Court in 1937. On March 9 of that year, he gave one of his "fireside chats" on radio, when he told the nation of his intent to reorganize the Supreme Court. Much like the Dems of today, Roosevelt didn't like a SC 5-4 decision. The Left is nothing if not persistent.

Hi Wofie ! Hope you’re well.

-0 is such a vile and evil tyrant. At least,
I guess, FDR wasn’t in the front of a packed
Senate chamber, facing .. menacing the SCOTUS
dead on, in a televised slapdown before the world.

The more I think about it, the more shocking
it is.

It truly was a horrid “banana republic” display —— the supposedly independent SC being hectored and harangued by the dishonest thug at the podium, while rabid socialists leap to their feet cheering in pandemonium.

Has there ever been a comparable display at a SOTU address? Yes, Andrew Jackson railed against the court but he couldn’t do it with them sitting in front of him at a SOTU address on national TV.......

Obama might be many things, classless, a p*ssy or a homo, a "thug" he is not..........

According to my OED "thug" is from Hindi thag 'swindler, thief', based on sanskrit staghagatl "he covers or conceals".

He hires the tough guys (Rhambo??), who reflect the other meaning of "thug" that is sometimes used.

[And then to receive a resounding ovation from fellow Democrats standing to applaud and cheer Obama. . .]

It's safe to say this was the last State of the Union many of these Democrats will ever attend.

Obama is the quintessential example of an ego-centric personality. He is THE worst thing to happen to this Nation in decades. His ego and socialist ideology has NO bounds.

If this marxist, along with his many fellow travelers, manage to take over 1/6th of our economy (health care), install "cap and tax", and enable "illegal alien amnesty", this nation will be just one more on the ash heap of history. There will be no turning back, because those who benefit from such policies will never let go.

As a man living his twilight years, I have nothing to lose anymore. I've done the street demonstrations and they worked sometimes, but things are quickly growing past those benign efforts. It's time for more assertive action. I've posted many replies that those who march on DC (TEA Parties and such) should just sit down and refuse to leave. It worked for the hippie scumbags to cause us to lose the Viet Nam war. Why wouldn't it work for our cause? The movement needs to be more assertive.

I've also posted many articles about State Nullification. Got few replies and was pooh-poohed, but NOW everyone is talking about it. Many States are passing resolutions and laws to re-assert their 9th & 10th Amendment rights. I still believe that to be the best way back to our Constitutional heritage...before the People initiate RWII.

As I've said many times on this forum, "we all die". What will you die for? Waste away from old age in some hospital hooked up to a machine, or sitting in some "retirement home" wondering who will change your soiled pants? Or will you make something of what is left of your time on Earth?

Do you have the b*lls to try to restore the promise of America for your loved ones, friends, and compatriots? Will you take a bullet, no matter where it hits? I have given an Oath to do so. I would probably be the biggest wuss and scream and cry out in pain, but I still would not renounce that Oath. Well, unless I was tortured... Then it would be untrue anyway.

All the above said, I bet most National Guard, and if Obambi decides to ignore Posse Commitatus, the Marines and Army will not fire on their own brethern in this day and age.

Mark my words on this post!: If DC keeps pushing and gets its way, a real fight is coming. It will probably start with some small remote group who will be destroyed for their efforts. When that happens, providing they are not some stupid cult or outlaws, all hell will break lose. Personally, I believe Texas will be the flash point.

Main Entry: mi·li·tia Pronunciation: \mə-ˈli-shə\ Function: noun Etymology: Latin, military service, from milit-, miles Date: 1625
1 a : a part of the organized armed forces of a country liable to call only in emergency b : a body of citizens organized for military service
2 : the whole body of able-bodied male citizens declared by law as being subject to call to military service

United States Code: TITLE 10; Subtitle A; PART I; CHAPTER 13 § 311. Militia: composition and classes
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

We are on the cusp. We either accept our finality towards socialism or we fight it. We can fight through the political machine or if that is for naught that we fight with our our sacred honor; our livilihoods (take care of your family resoureces), and our lives.

Things are coming to the boiling point. Either boil in the hopeless socialist agenda or hop out of the pot and fight, fight, fight. What is your turning point? Think carefully. It is about going along to get along or supporting a societal compact that has given you so much?

Best to all in these trying times.

It’s “Alito”, not ‘Alitoto’. The Aliotos are a very old San Francisco family of corrupt leftist rats.

They have good restaurants, though.

What do you expect when there are no standards? We all know free speech is a right, but without responsibility it's devalued greatly!

Without accountability it's useless. We are responsible for holding our freedom in check.
