Minor vs. Happersett:
The Constitution does not in words say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners.

In Wong Kim Ark:
On the basis of the 14th Amendment, however, the majority opinion coined a new definition for “native citizen”, as anyone who was born in the U.S.A., under the jurisdiction of the United States. The Court gave a novel interpretation to jurisdiction, and thus extended citizenship to all born in the country (excepting those born of ambassadors and foreign armies etc.); but it did not extend the meaning of the term “natural born citizen.”

As for Scalia, thankfully there are more Chief Justices, but certainly his voice will be heard.

Haven't you guys figured it out yet??? They avoid threads like these in which the phrase "natural born citizen" is clearly defined by numerous Supreme Courts so that they can complain on the other threads that there is no definition for it. Staying stupid by avoiding factual threads and absolute truth and firm documentable definitions is their modus operandi.

Ah — I missed you there, James. Trials are trials and opinions are opinions. Do you disagree with etraveler’s take? Did the four justices, or did they not, offer opinions that would disagree with Obama’s alleged eligability?

Yes -- it matches my handwritten copy which is easier to read than the one at the link:

"the Law of Nations" is the final phrase at the end of line 12 under Section 8. And "L" and "N" are definitely capitalized.

Its too bad the same court will be under too much pressure by their employers to apply an imperial definition.

I mean under the laws then in effect Obama’s mother was too young to pass on citizenship, so there only remains the fact that Obama was born in the one of the United States, to a mother too young to pass on citizenship, and a father who was a foreign national.

Does that make him a natural born citizen, just a deface citizen or not a citizen at all by virtue of his father.

There are 3 possible Status for Obama:
A: Natural born Citizens (either by Birth or by mother)
B: Simply Citizens. (for lack of transition or forfeiture to be regained later)
C: Not a Citizens for lack of transition or forfeiture.

Theses questions have significants in the issue of our immigration issue. If foreigners have citizenship in the Untied States simply by being born in the United States as is presumed to exist under the 14th Amendment then this creates a major illegal immigration problem for us.

Otherwise Obama’s citizenship is entirely depended upon his mother who was at the time too young to transmit her citizenship, under the then existing law.

So the questions are:

1: Was he born in Hawaii?

Assuming he was which is what the evidence suggest there are more questions:

2: Was his citizenship given to him by birth in Hawaii or by parents?

(Note: This is the important question I spoke of above as it has significance implications to our immigration problem.)

Assuming he somehow acquired citizenship either by birth or thou his mother there are 2 further questions:

3: Did Obama acquire “natural born” citizen status thou the above means?

Assuming he did acquire such “natural born” citizenship status thou the above means:

4: Did Obama ever renounce such citizenship status thou his activities in Indonesia?

Note: many of theses questions could also be applied to John McCain who’s only clam to Natural born Citizenship status is thou his American parents, as he was born in Panama. An interesting paradigm as if Obama’s mother was too young to transmit citizenship status and such status does not come from mere birth in the United States then McCain was the only presidential canadit that was eligible, otherwise Obama was.

There must be 2 separate methods for obtaining such status if they are both eligible, or the law which made Obama’s mother too young was unconstitutional.

Hmmm..... Looks like Applewood Books of Bedford, MA is guilty of a rather glaring oversight. They didn't capitalize those two words in my pocket edition of the US Constitution (ISBN 1-55709-105-6).

My excellent copy of the Constitution that I downloaded from Congress's website (not there anymore) also has the "Law of Nations" in capital letters.

The left has been doing a subtle campaign to change the meaning and intent of the Constitution for who knows how long.

In my hands I have a copy of "America's Constitution ; A Biography" written by Akhil Reed Amar who is a member of the Yale Law School faculty. He has "written widely" on constitutional issues for the New York and LA Times and the Washington Post.

Amar wrote on page 164, "Early America's evident concerns about presidential dynasties also lurked beneath Article II's most questionable eligibility rule: its requirement that a president be a "natural born Citizen" -- that is, a citizen at the time of his birth.91 By gererally prohibiting immigrant-turned-citizen from the presidency...."

The footnote Amar cites is Jill A. Pryor's publishing "The Natural-Born Citizen Clause and Presidential Eligibility: An Approach for Resolving Two Hundred Years of Uncertainty" Yale Law Journal 97 (1988):881.

Pryor is a tool and probable loon for the left. They are an insidious crowd. See below:

A)Unless his father is a US citizen, and not Barak Obama Sr
He is not a Natural Born Citizen.
B)He cannot be a Naturalized citizen as his mother cannot confer citizenship per the law. She would have to be 19, she was 18
C)This is my guess. His father was a subject of Great Britian, and his mother was too young, and not in the US long enough to confer citizenship to Obama. But, even if she were, he would be a dual citizen (Great Britian and the US, and GB did not allow dual citizenship then) so he would be a British Subject. Then he was adopted, and his parents became, hence he became a citizen of Indonesia.

The only thing that Hawaii could possibly give him was a COLB(Certificate of live Birth), which had 4 methods of acceptance in 1961, which does not convey citizenship. A Birth Certificate conveys citizenship.
