The Executive Order is probably one of the most misunderstood elements of Executive authority. It cannot undo enacted legislation. To put it simply, the President has to cite a specific piece of legislation that empowers him to set or refine guidelines.
If the abortion language in the Senate bill (H.R. 3590) says "X", an Executive Order cannot make it say "Y". It just doesn't work that way - ask Harry Truman.

I don't know very much about Harry Truman. Did he have a problem with an executive order?
