This SC has done big things in regards to the 2nd amendment and campain finance. I suspect they will address at least some of this bill. They actually seem to be using the Constitution in their recent decisons.

The federal unemployment law, is a lot lower than a host of states, but the states higher unemployment prevails..why does not the federal law trump this I wonder..

The fight is over. I know it's been a day of bad news but I beg to differ. If enough states band together, the Federal government can't just ignore them. The real test hasn't even begun yet. On the positive side, the Democrats have outed themselves as the new Communist party, and will be crushed at the polls accordingly. There are enough people out there who recognize this healthcare bill is unconstitutional, and won't just accept it as a done deal.

Federal law does NOT trump state law if the federal law is fatally unconstitutional, which the personal mandate IS IMO. One way or another the SCOTUS will rule whether the personal mandate is Consitutional, and it’s not.

No, in this case the Federal use of the interstate commerce clause, their 'coverall' for interference in the State's, will have no standing.

The Federal Gov't can't force individuals to buy something.

And if that happens, the time has long since come for states to say, "Guess what, we don't care." It's time for we the people to say, "We don't care." We have been like frogs in a slowly heating pot of water for four decades. Now the water's boiling and if we don't hop out immediately, it won't matter.

The court will not interfere with how laws are passed in Congress. Its the separation of powers thing. They may look at enforceability of certain parts as it affects individual constitutional rights but, McCain Feingold has been law for 10+ years and is still not fully repealed. Once a law, always a law. Name one stinking piece of legislation that has ever been repealed! Even the Spanish American War tax on telephones took over 100 YEARS to repeal. This is now the law of the land and we will own this for the rest of your lives. I suggest you encourage your children to migrate to freer nations with lower tax rates. America, the great experiment, is over...

No, it's not over, and I'm getting sick of hearing of people drinking and crying over this.

If we as private citizens of the United States of America are even willing to entertain the notion of the legitimacy of this legislation, and are too cowardly to accept the prospect of consequence of ignoring it on the basis of its violation of the enumeration of powers in Article 1 Section 8... then we must ask ourselves a penetrating question: Do we really deserve a free republic?

The Federal government cannot mandate that someone buy a product and if they don’t, fine and imprison them. This is not like SS or anything else that we have ever seen. Every resident of this country must buy government approved health care insurance. It is unprecedented.

I understand your frustration and feel it too. But this is not over unless we roll over and let them win. This is very much the time to stand up against this usurper and his minions in Washington and really begin to fight. I think, in a perverse way, obama has done us a favor...he has united and excited the “silent majority” in a way I have never before seen. If we stay strong in conviction that this bill (and others obama has planned) is unconstitutional, we can beat him and the other socialists in this country. If we concede, we lose outright without even a real fight. I don’t intend to give them that satisfaction! (maybe it’s time for a to watch Mel Gibson’s The Patriot again :-))

Here's a small amount of comfort: The USSC can say anything they want, but they have no power of enforcement. Yes, Obambi has such, but the if the States/People simply choose not acknowledge such bad USSC decisions and choose to follow the original intent of the Founding Fathers, we COULD prvail. It will take fortitude and possibly civil disobedience, which I've been promoting for some time.

/sarc Yeah..that's why the Supreme Court eviscerated most of McCain/Fiengold and declared most of that law unconstitutional right?
