Yes, in fact, this would have the IMPACT, if not the INTENT, of racial discriination, in that the law has a disparate impact on light-skinned people because dark-skinned people do not use tanning beds.

State auto insurance laws are “apples” and the requirement in the new federal legislation for citizens to buy medical insurance is an “orange”. Driving on public highways is a privilege, so having liability insurance makes sense. (Some of the restrictions are of dubious constitutionality, in my opinion.)
In contrast, the care of you own body is your own business. If you don’t get recommended surgery, for example, you would do no physical harm to anyone else but yourself. You have a right to life and liberty. Congress does not have the authority to require you to buy any product. If it did, the next thing on the horizon might be a requirement that you take certain vitamins or get a flu shot, or pay a fine, just because the federal government thinks the vitamins or the flu shot serve the “general welfare”.
This has been misrepresented because probably no body really read and or understood the language.
So if I can buy outside the exchange how does that keep costs down? The exchange seems like an exercise in futility
