5 Agents busted in my door this morning - Unlawful entry 3-30-2010 - 6:30 am

Police trying to locate someone on a bench warrant search a woman's house without her consent. They produce no warrant - bail agent says he does not need one. She repeatedly denies them permission to enter. Some of the police enter through a back door also. The person they were looking for was not there. She said he did not live there. Not sure if he had listed that address or not.

Sheriff’s busted into my private home at approx 6 am on Tuesday March 30, 2010. They banged on the door and yelled “Open up... Kern County Sheriff” etc.. for about 4-5 minutes.. I was alone and they were looking for Joe, the man they beat up on the roadside a few months ago in Bakersfield, California. (see video “Joe Police Brutality on my channel” They said they had a warrant but when I demanded to see it, they then retracted their statement and said “We don’t NEED a warrant!!” They threatened to arrest me.. and tried to ORDER ME in my private home to “{back off” of them. See for yourself if I backed off... I do not follow orders of color of law nazi military agents.. they have NO AUTHORITY and NO JURISDICTION. They unlawfully entered and terrorized me. Then they went to my friend Alan’s dad’s house where he was and approached him with guns at his head and threatened to “RIG” a drug test on him to frame him for something. They also said they would kill Joe if they find him. They refused to identify themselves and when I asked one if he was a robot.. he replied “YES”!

Yeah, it’s a bit hard to say someone busted down your door when you opened to door for them and allowed them to walk in. I don’t think she told them they didn’t have permission to come in until after she let them in.

Should have let them smash down the door. Would have made a much better video. She could having been screaming and carrying on and yelling for help.

They did not arrest her. They weren’t looking for her. She must have been expecting them because of the camera.

Whatever nOOb. The title of the Post is itself misleading and purposely so.

It think if you go back a ways on FR you will find that the proper practice is to post the headline exactly as it appears and not change it.

This practice was started to prevent duplicate posts, people changing the headline and then posting the same exact story. This NooB even remembers the days when we had to switch off open html tags otherwise until someone did the entire rest of the post (for example) would be in Bold (do you?). Thankfully JimRob put in the correction years ago.

Suggest you go back to your FR stylebook. You are not as smart as you think you are.

This is odd... The tape starts off almost like she’s expecting them to come. The way she’s handling the situation it’s almost like she planned to cause a scene. It is unclear whether or not the officers and private party (bail enforcement officer) had a right to be there. They insist that they do, but can’t produce a warrant when she asks for one, telling them that legally they don’t need one. It is also unclear if she knows the party they are looking for. I’m getting the impression that at the very least, she’s familiar with this person. Some of the things she’s saying don’t make any sense either. “You have been served.” What does she mean? “I can buy one of those badges at Disneyland.” huh? “Full Commercial Liability” wtf!?! “Are you a robot?” Jeez... These cops might very well be wrong, but I have a hard time feeling sorry for this doofus.

Laws are different regarding pursuit of someone who jumped bail. If they were bailbondsmen they can do as they please with no warrant. If they were sheriffs department, then you have something.

It was a bail enforcement agent (bounty hunter), backed up by some county sheriffs.

I don’t know, and maybe somebody can back me up on this, but I’m guessing that in the bail contract you agree to let the agents of the bail company onto your property to locate the subject if they skip on the bail. Warrants have nothing to do with it at that point. It’s a private contract and you’ve already given permission in the fine print.

Okay nOOb. They definitely require a warrant. They cannot take the bail enforcers word for it and enter a home with out a warrant.

The bail enforcer has no legal or lawful right to be in the house.

The deputies erred in by answering her question “why are you in my house?”.

“well, ma’am, you opened the door”, on officer said.

Opening a door is not an invite nor is there implied permission. She did not give expressed permission and they are in error as well.

Hate to say but, the fellow they are looking for may have been in the house, at one time. However, without lawful reason no one has the authority to enter her home.

The bad guy will be caught eventually. Meanwhile she will be living high on the hog after she sues the bail bondsmand and the surety company pays.

Then she will go after deputies and the county they represent. The deputies will get a letter in their file and the countly will by her an upgraded mobile home. She will by a new Yugo, have it limousined and tricked out with dingle berries hanging from the windows and a bean bag chair in the back for loungin while drinking Mickey 40’s.

She will probably decide she is too fancy for the neighborhood she is living in now, due to her new found wealth and she will homestead in the Oklahoma panhandle or some other area where the tumbleweeds outnumber the residents.

She might even hire a banjo quartet for the weekends so she can hear her fav-ah-a-rite tune over and over again

She might even start a little hog farm and have some pet goats.

But,... At the end of the day none of those men had a lawful reason for being in her house and searching it.

Let’s see...4th, 5th, 9th, 14th, unreasonable, bill of attainder, etc.

Post on and try to let us know more about the title. We are funny about that stuff around here.

She opened the door but did not expressly give permission. The paper boy can come to my door and I will open, it his friend walks in the back door or through a window, as happened in this case and the paper boy comes into the house, with out permission... Well...We gonna have a heap a trouble.

B&E does not require and actual breaking of anything.

The question we should be asking is "Was that house listed on the Bail Bond"? If so she has a weak case.

From what I saw she opened the front door and a man approached from her rear meaning he came in through another entrance, possibly the back door.

I think she has an excellent lawsuit. I’d get an attorney who works in another County and proceed to sue.

If there is indeed a bench warrant for someone’s arrest, AND if there is PROBABLE CAUSE TO BELIEVE THAT WARRANTED PERSON IS INSIDE, then yes, they have the right to enter the home.

Sounds to me like camera was rigged in advance because she was hoping to be able to film a supposed “illegal” entry. Cops and bounty hunters didn’t just fall off the turnip truck. Can’t say the same for her.
