MN attorney general sides with feds on health care

Minnesota Attorney General Lori Swanson has rejected a request from Gov. Tim Pawlenty to sue over the new federal health care law.

Instead, Swanson said Monday she will file a friend-of-the-court brief supporting the federal government in a lawsuit filed by 13 state attorneys general.

The Democratic attorney general sent the Republican governor a letter saying a lawsuit isn't warranted because health care fits squarely within the federal government's authority to regulate interstate commerce.

When this first came up, I stated here that there was no chance that Swanson (DFL) would act on behalf of the state.

if the atty gen doesnt want to file it on party lines....is there a way in the MN state constitution where the gov can file if it does not take from state funds?

This will be interesting. I would think that if Pawlenty has Presidential ambitions, he should fight against this new entitlement. Just sitting back and not fighting against this federal power grab from states would not gain conservative support.

Mike Hatch still exerts considerable influence at the AG’s office - even though he hasn’t been AG for four years now. it is a well-known fact over at the Capitol.

Whatever Mike Hatch wants, Lori Swanson acedes to.

I can see the day when a State AG can sue against the Chief Executive of the State. Government will come to a screeching halt. Who is in charge? This will show whether Pawlenty has the gonads to be President.
