New States Join Courtroom Revolt Against ObamaCare (Five more: IN, ND, MS, NV and AZ)

Five more U.S. states have now joined the attorneys general of a dozen other states in a lawsuit aimed at toppling the federal government’s new health care law.

The states assert that portions of the health care legislation signed into law by President Obama on March 23 amounts to constitutional overreach that infringes on the right of states and individuals to manage their own affairs.

"We welcome the partnership of Indiana, North Dakota, Mississippi, Nevada and Arizona as we continue fighting to protect the constitutional rights of American citizens and the sovereignty of our states," said Florida Attorney General Bill McCollum in a statement.

“On behalf of the residents in Florida and the states joining our efforts, we are committed to aggressively pursuing this lawsuit to the U.S. Supreme Court if necessary to prevent this unprecedented expansion of federal powers, impact upon state sovereignty, and encroachment on our freedom,” McCollum continued.

The attorneys general of Alabama, Colorado, Louisiana, Michigan, Pennsylvania, South Carolina, Nebraska, South Dakota, Texas, Utah and Washington had already banded together with Florida to file a lawsuit against the federal government with the US District Court for the Northern District of Florida.

The lawsuit contends that the Patient Protection and Affordable Care Act (PPACA) infringes upon the constitutional rights of the residents of states by forcing all citizens and legal residents to carry qualified health insurance or pay a financial penalty.

The states contend that the insurance mandate exceeds the limited scope of the powers granted to the federal government under Article I of the US Constitution. Furthermore, they assert that the tax penalty for not carrying insurance violates the prohibition against the direct taxation of individuals outlined in Article I, sections 2 and 9 of the Constitution.

The suit also contends that the PPACA infringes on the sovereignty of the states guaranteed under the Tenth Amendment to the Constitution by forcing the states to abide by new operating rules and mandating that they spend billions of dollars to support the new health care system, when they already face severe budget crises.

Virginia has also filed its own separate lawsuit against the federal government, reiterating many of the concerns of its fellow states. Virginia has already passed a state law that expressly forbids the government from mandating that citizens carry health insurance or pay a penalty.

The addition of the five new states brings the total number of states involved in the Florida-led lawsuit against the federal government over ObamaCare to nineteen, including Virginia.

A hearing for scheduling the Florida-led suit is set to take place April 14, 2010 at 9 a.m. central time at the Federal Courthouse in Pensacola, Florida.

He sacrificed his chance to be elected Senator to be a House Messenger during the Clinton Impleachment.

Now running for Gov to replace Charlie Crist (RINO-Fire Island) who is leaving to try to be a Sen, but is getting DESTROYED by Mario Rubbio.

I wondered the same thing myself because this has quickly become a legal tidal wave rolling directly at DC.
The rabid idealogue leaders of this regime will ignore it and take their chances in court.
Sebelius’ claims of partisan griping being the impetus of these lawsuits can be easily disregarded as nothing more than ‘Rat partisan griping at this point.
This bill was devised, written, voted for, and celebrated by Demrats alone and come hell or high water, they alone will reap what they have sown come November.
You think people will calm a bit in the coming months?
The people that these pols kick in the teeth with such ease will overwhelm and shock them in the most American way possible, at the ballot box.

Here's what the GOP needs to do. Get at least one person per precinct in the urban areas, where they have high Hispanic voting numbers, to stand outside the 100 foot marker sign at the polling place. Say nothing to anyone. Just walk around all day with a jacket with yellow letters on the back that say: I C E (Immigration and Customs Enforcement>)

That will scare away half the Dem vote. If they can be scared off, then they need to be scared off. If the Dems can put Black Panthers outside the polling places in Chicago, hey; what's good for the goose..........

Quite a few private suits(standing???) being filed against Øbamacare in addition the States. Not only does this unconstitutional POS need to be killed, it needs to be entombed in double concrete vaults and a parking garage built over it. And nothing of its kind to ever see the light of day again! The complete list of States AFIK with contact points including NORTH DAKOTA, which I missed in an earlier thread. Let them know how you feel. The support could just make all the differnece in the world, especially to those bucking heavy resistance within their own States:

Are all of these States filing separate lawsuits or are they joining forces in one lawsuit?

My best count is 18 States have joined the suit filed by AG McCollum of Florida. Virginia, for whatever reasons struck out on their own. I THINK they were the only State that actually had a State law in place in defiance of Øbamacare before Øbamacare passed. May have had something to do with their decision, but don't know for sure.

Going back and checking my list, it looks like 18 other States have joined the suit filed in Florida, making 19. Adding Virginia makes it 20 altogether, but it's really late and things are starting to run together.

You’re welcome. I hope Freepers take advantage of it and with just a few clicks can send a message of support. I’ve gotten on a couple of Facebook pages and tangled with a few moonbats who were throwing bombs at their State’s effort to poke the federales in the eye. Kinda fun actually if one has the time, which I occasionally do.
