Well, the justices frequently leave at the end of the Supreme Court term in late June or early July. Then their replacements can be confirmed by the traditional 1st Monday in October start of the new term.

If things go smoothly that’s what happens. See if Obama has the stomach for a big battle over getting someone very very liberal confirmed this year.

Only 4 months to stonewall on his replacement,until Senate elections - in a normal govt procedure to turnover USSC

But I doubt the reds (the real reds, who posture in blue states) will honor process anymore than they have done to date

the manipulation swan-song Reid and obama will use to speedily install a replacement, will be another Constitutional debacle

This is great news. Obama will put in a communist judge and cause a big fight right before the elections. The one thing we don't want Obama to do is pivot. Keep him fighting on the left up until November and keep the voters mad as heck.

I was under the impression that he had died a few years ago but the Dems were doing a Weekend at Bernie's pretending he was still alive until a Dem became president.

Seriously, I expected him to retire very soon after Obama's inaguration. I'm surprised he lasted more than a year.

The nuttier the replacement Obama nominates, the worse the confirmation hearings will be for the Democrats right before the congressional elections.

The timing is great for the Republicans. He either has to go with a milquetoast run-of-the-mill statist for an easy confirmation or he goes for a full monty marxist and kills his party in the elections.

Huffington Post already lists Cass Sunstein as a "strong contender" - that one would be fun!
