Knowing what I do about the deviant cretin in the WH, I'd expect that he will put forward his real first choice second, since he may be anticipating a fight in Congress.

On the brighter side, it'll be dam near impossible to get someone any farther to the left than this loon. Possible, but 0 is going to have to look hard-and then MAYBE the spineless republicans in the senate can really make hay during the confirmation hearings on whatever new commie 0 wants to implant.

One thing you can say about Stevens (as well as Souter) in that he was a traitor to the end. He could have retired while a Republican was in office since he was appointed by a Republican, but he wanted to make sure the Marxists kept his seat.

I wanted him to last at least until we had a better chance to get a better candidate with more GOP Senators in 2011. Maybe the GOP will have the balls to filibuster until then.

Republicans won't fight. They see it only as a liberal replacing a liberal.

Idiots like Hatch and Graham will put up token resistance then capitulate with "He was elected President, he's entitled to his choices."

They don't see the ultimate worth of attempting to stop Obama the same way that Dems blocked Bush. They won't trash the nominee, because "Republicans just don't do that sort of thing."

I say it’s Elena Kagen...

I bet the reason this got floated out there, then it appeared the retirement was still up in the air, was that ther was not a solid cadre of nominees in the bullpen “ready” to fly when the nominee needs to be announced...

There will be a 2nd and 3rd choice out there ready to go as well incase the 1st choice doesn’t make it...

Who knows this may be the way of the future...In this job it never pays to be the first choice (nominee)...The 2nd or 3rd choice would be the ones I would be concerned about...

This is the biggest problem with a Dem being in charge. They can appoint judges to the Supreme Court. It doesn’t help at all in overturning Roe vs. Wade.

The Constitution requires that a replacement justice be appointed by the "President".

In order to be eligible to hold the office of President, a person must be a Natural Born Citizen which Obama is not. He was not born in the geographical territory of the several states but was instead born in Mombasa in modern Kenya under circumstances in which he is not even a citizen of the United States at all.

So any litigant before the Supreme Court ought to have standing and the right to challenge the ability of any replacement for Stevens as well as Ms. Sotomayor to sit on the Court in their action.

Such a challenge ought to be an effective claim on which to force discovery and a hearing on any factual argument about where he was in fact born. The result ought to be a precidential holding that he is not eligible to be President and therefore does not hold the office.

Not likely that he could continue to occupy 1600 Pennsylvania Avenue very long in that circumstance.

That is what I find so despicable. The Supreme Court is the highest court in the land & the judges should not be so openly blatant about their biased views.

Stevens sees what the marxist is doing to our country & it's unthinkable that he openly makes no secret that he is so anxious to do this to our country & making sure it happens before the 2012 election.

We need a national prayer day for our country - even if it's only among ourselves. Our very life & America is in God's hands now.

I don't know about that - anyone remember how long the Dems held up Borkh? Of the MS Judge who ultimately withdrew because he was guilty of the unspeakable act of "going easy" on a first-time, youthful offender who was involved in a cross-burning?
