I think you're absolutely right. He certainly will be tried, and probably convicted, of missing movement and conduct unbecomming. If he's charged with failure to obey an order of his surperior then that superior will be this Colonel Roberts or an officer further up the chain. Obama will never enter into it.
And if he sues then he can't establish standing because he can't establish a causal relationship between his injury and Obama's actions. He'll go down in flames and it won't change a thing.

An affirmative defense to disobeying an order is that the order was illegal. But, as an affirmative defense, the defendent must prove that the order was illegal. He must be given the opportunity to do so.
