Something is @$$backwards here. I don't want to hear that's how it's always done because 'this' has never happened before.

This man took an oath, as they all did, yet they are not allowing him to follow it. In fact, all his 'bosses' should be tried for ignoring the Constitution regarding 'enemy within'. Do THEY have proof that Barry is eligible?

Lakin took the oath first, then became a officer. If he refused to take the oath - that pledge - he wouldn't be allowed in the military. They are preventing him from his first duty, obey his oath to his country.

Does the military have proof of legitimacy and - being 'sworn in' is not proof. Any more than an officer being sworn in that doesn't take an oath. The reason for the existence of our military is to protect us. The military is ignoring their oath and demanding him to ignore his.

It's a Court Martial. Matt Dillion will not be there.

But the rules allow an Affirmative Defense that the order disobeyed was illegal. He must be allowed to present that defense.

He'd better be right in thinking that the order was illegal, or more properly that the ulitimate order giver was not entitled to issue it.

He knows the ramifications of his actions, but he's falling on his sword, so to speak, to advance a higher cause, as HE sees it.

Military courts are not the same as, nor are they run the way as, civilian courts.
