Officers are obligated to determine whether issued orders are legal. He’s got standing. US v. Calley.
Question is whether he has a case. I can think of a dozen ways the US can argue this without bringing up the notion of whether the President is qualified to hold the office under the Constitution.
This all depends on how good his lawyer is, I’m afraid.
I retired from the Army as an 06 fight surgeon in Dec of 05 with two back to back tours in Iraq with the 189th Blackhawk Bat.. from the Mt, Army National Guard in Helena Mt.
