Officers are obligated to determine whether issued orders are legal. He’s got standing. US v. Calley.

Question is whether he has a case. I can think of a dozen ways the US can argue this without bringing up the notion of whether the President is qualified to hold the office under the Constitution.

This all depends on how good his lawyer is, I’m afraid.
