A panel as you describe can only relieve him of duty, not assign punishment unless he agrees to administrative punishment. He has a right to a trial, even in the military you have this right.

The panel I described is the jury panel at his Court Martial trial , the court will prescribe punishment after he is convicted . Nonjudicial punishment is not even a factor . I was going to say I was sorry about the clown remark , but you insist on removing any doubt about it
