Upon viewing the press conference, I asked myself: which part of this could not have waited until after the market close? Absolutely none. Coming out with it during market hours has created enormous chaos and cost retirees, widows and orphans --- people heavily invested in stocks --- great deal of wealth and income.
There only reason they came out in the afternoon was that the Main Street would be likely to hear it: a few hours later people would be driving home or watching a reality show. It was "get maximum political benefit and to h-ll with the cost to our economy."
It is now increasingly clear that the government does not have a case.

If you wanted to make an example of the industry and attempt to co-opt or intimidate Republicans in Senate to go along with Finance Reform bill, while at the same time protecting your friends in the industry (GS) from any actual harm, you could not do any better than to come up with an incredibly weak, full of holes and factual errors, simple contract law case which is almost certain to lose in court.
Several birds with one highly publicized sensational phony lawsuit. Yes, there is definitely a fraud in this lawsuit - the fraud is the SEC lawsuit itself.
