(04-23) 18:50 PDT OAKLAND -- Prosecutors had no grounds to file murder charges in the fatal beating of a 59-year-old San Francisco man on a downtown Oakland street, an attorney for one of the defendants said Friday, describing his client as "not an evil person."
"This is not a murder case. This is a case that, in our opinion, has been overcharged," Adanté Pointer, attorney for defendant Lavonte Drummer, 18, said after a brief hearing in an Oakland courtroom.
Pointer said the case could be "something else," but did not elaborate on any potential defense.
Drummer and Dominic Davis, 18, both Oakland residents, have been charged with murder in connection with what authorities called a random, unprovoked attack on Jin Cheng Yu, 27, last week and the subsequent fatal beating of his father, Tian Sheng Yu.

Yes, I’m perfectly serious.
Yeah I know. Both suspects had tough childhoods...beaten by their mothers; beaten by their fathers; got into trouble before, but they were “just turning their lives around.” And they are both good boys, kind to dogs and children.
I don’t care what the circumstances — beating a guy to death is murder.
My view is that the punishment should mirror the crime. If they are found guilty, they should be locked in a room with the victim’s loved ones who should proceed to beat them to death. I’ll even buy a couple of Louisville Sluggers for the occasion.

It is necessary to understand that Blacks cannot commit a hate crime, and being oppressed, must be allowed to strike out at any time to ensure high self esteem.
Additionally, it is racist to complain about a minority raising their self esteem, and it is racist to not be aware that ethnic Black minorities are more equal than ethnic Chinese minorities.
Understanding these American values, it becomes clear that these innocent youts are being persecuted by the man.
These guys had a history of this kind of behavior. They beat an old man to death.

In Lib stupidthink, unless the culprits intended their victim to die from the multiple punches and kicks they administered to his head, it is not murder.

Some lessons here besides the obvious. They engaged in the atypical thug attack, initiated with a out of the blue sucker punch. Then killed the father for even daring to speak up.
I cannot say this enough times, folks, you have to be on your toes around guys like this. You have to treat them as if they are sharks and you are in the water with them. They will give off the predatory clues if you are looking for them and if you give them a flank, they will take it. They have been told all their lives that everyone that is different from them are responsible for all their miseries. Thus they have have absolutely no compunctions about beating you to death over it.
If someone you are with gets sucker punched and you intercede, you better be armed with a firearm, because as you can see, as mad as they were with the first victim, the prevailing sense with them is “You interfered with us, now you have to die.” You can easily justify that you could not hope to go fisticuffs with however many young men and win. (Even if you could, remember always say you were in fear of your life). Almost all physical fights wind up on the ground and thugs like these have absolutely no problems with squashing your head like a grape. In fact, they look for that very opportunity.
They will almost always target the male of any couple, since he poses the most threat. Impress this upon your female companions that they need to be able to shoot, be prepared to kill to save themselves and others and they should carry as well. A female has an even easier time justifying deadly force.
I am firm believer that humans are not born with a conscience. It must be instilled and nurtured in them by other humans. Where this guys come from, a conscience is the last to be developed and the first thing to be discarded. They consider their own lives worthless and place absolutely no value on yours.
I have interviewed and interrogated many young men like these and one of the commonalities they all share is they NEVER feel remorse or pity and they never break down and shed tears.
I urge each of you to resolve yourselves never be a victim to thugs like these.
A random, unprovoked attack resulting in death is nothing if not evil.
Help relive prison overcrowding! Try and execute these killers within a year. But we all know these savages will get prison time
