Polanski Fails in Bid to Block Extradition
NY Times ^ | 04/23/10 | MICHAEL CIEPLY

The director Roman Polanski failed in his latest attempt to block his extradition to the United States from Switzerland, where he is under house arrest, and end the 33-year-old case against him for having sex with a minor. In a decision on Thursday, a California appeals court denied a request to end the proceedings by sentencing him to time already served, despite Mr. Polanski’s assertions that new evidence showed hitherto undisclosed corruption in the case....

Things should move fairly rapidly now. Switzerland could wait until the California Supreme court either accepts or refuses the appeal (which is surely coming) of the lower appellate court's decision.

Our extradition treaty with Switzerland gives the Swiss some latitude to extradite if the original sentence is 6 months or less. They aren't bound to extradite if the sentence isn't 6-months The problem is Polanski has never been sentenced, although his plea agreement was for something less than 6 months. Polanski fled before sentence could be imposed. And of course, he's looking at an additional 2-year sentence of fleeing the jurisdiction.

Man, he needs to make a documentary about this unjust threat to his life and show it at every film festival on earth and get film snobs everywhere angry enough to stop the government's sinister plan! And he doesn't have much lawyer-hours left!

Only one man can help him now....Al Gore!

He should be jailed for the rest of his life. I give a lot of credit to the person in the LA district attorney’s office for going after this POS.

And if I can just say — I am getting really tired of mentally correcting news reports of “sex with a minor,” to what he actually did — “forcible rape and sodomy of a semi-incapacitated 13 year old child.” And the response from some people, who should know better, of, “Oh, those silly Puritanical Americans, making a big deal out of a trivial offense — basically statutory rape — by this Super Genius” is just as bad. This is *not* a trivial offense. He accepted a plea for the lesser charge for likely many reasons, none of which I actually give a rat’s a$$ about.

"Our extradition treaty with Switzerland gives the Swiss some latitude to extradite if the original sentence is 6 months or less."

That is a typo on my part - the treaty gives them leeway for anything under 2-years (I believe), not just 6-months.

I am worried he will come back here an get a slap on the wrist and then be free to come here any time he wants. I would rather him just not be allowed to ever step foot in the U.S. again.

Remember, it not just the original crime, it's the fact that he fled. If he is in our country it's clear he won't respect our laws.

I could not agree more. I don't believe I have ever read a MSM press account of this case - since this whole extradition process begain - that made even a passing mention of the forceable sodomy.

The time for him to defend himself ended over thirty years ago.

He knew he couldn’t defend himself so he plead guilty, then fled.

Time to pay the piper Polanski. And knowing what you did to avoid justice, I hope they throw the damned book at you.

It's crazy California, so anything is possible. But, Polanski thumbed his nose at the California judicial system so plainly and publicly for so long, I believe he has made plenty of people angry. I think he'll do a year at minimum, perhaps more. I also believe that if he wants to do less than the two-years on the felony flight charge, they'll amend his plea agreement to make him register as a sex offender. He'll never be allowed back in the country, and travel to counties other than France, will be hampered.

Ya, like Whoopi Goldberg saying that this wasn’t “rape rape”. I think she was trying to say it wasn’t forcible rape. But, he drugged her, so it was not consensual sex with an underage girl. Good liberals like Whoopi are agahst at the use of date rape drugs, and I agree with them on that specific point. What he did was use a drug to make it easier to force himself on her.

Why Whoopi said it wasn’t “rape rape” is unknown. I think it’s because Whoopi is a Hollywood idiot, and the Hollywood idiots think Polanski has been persecuted, because Polanski is one of their own. He has “suffered” because he hasn’t been able to return to America to be feted by the other Hollywood idiots at Oscar awards and other shows. And we’re supposed to feel sorry for him being persecuted.

But... but... but.... he’s a talented director! We can’t force this man to face justice in the rape of a 13 year old girl because he makes good movies!!!! (/sarcasm off)

Put him in Pelican Bay Penitentiary in a dress with lipstick. Then he’ll know what that girl felt like.
