Birth of a President: McCain Birthers, Obama Birthers, and a Fellow Named Wong Kim Ark

In 2008, the birthers, in full throttle, were in hot pursuit of any case or controversy they could find to stop the man. They wanted him off the ballot completely. Or, if that failed, they wanted him at least ruled ineligible to become President of the United States. The controversy had been stoked by media reports, including in the New York Times. It finally led to an inquiry in Washington, D.C., in an elegant conference room. The Chairman of the Senate Judiciary Committee, Senator Patrick Leahy, D-VT, banged the gavel and officially opened a congressional hearing. The burning question of the day was to inquire into the birth and constitutional eligibility for the presidency of John Sidney McCain III.

One can only imagine what this ongoing debate about the presidential eligibility of President McCain might be like if, in addition to questions about his place of birth, McCain had had dual citizenship at birth -- for example, had he been born to a mother who was a U.S. citizen and father who was a citizen of Panama. (And never mind what brouhaha might be engendered if, decades later, Cindy McCain referred to Panama as her husband's "home country.")

Far from establishing a blanket rule that any child born in the U.S. is a natural-born citizen -- far from ruling that mere place of birth trumps all other circumstances -- the Court in Ark began its analysis with a thorough and careful review of the facts regarding Wong Kim Ark's actual ties to the United States, beginning with the ties of his parents.

The constant left wing harping about "birther kooks" wanting a real birth certificate is a deliberate ploy to dumb down the meaning of NBC to birth place only.

Actually the COLB proves the Resident is NOT a Natural Born Citizen.
The newspaper birth announcements, and his own book, are secondary verification of Non-NBC status.

Factually incorrect. The Court starts with a long argument that natural born citizen is the equivalent of natural born subject, and uses the latter to understand the meaning of the former.

That is important because a natural born subject included anyone born in the realm whose parents were not diplomats. I believe the Court went to far in WKA and failed to appreciate the difference between 1600 and 1900, let alone 1600 and what we now have in 2010...but their reasoning was not totally illogical.

They were not, in any case, addressing the NBC status of a child born to a citizen mother illegally married to a non-citizen father who then raised her son after the father abandoned them.

In honesty, the Founders never conceived of the possibility. Suppose you were having dinner with George Washington and Thomas Jefferson, and you asked them,

“Hypothetically speaking, suppose a black man from Africa came to study in the US, and illegally entered into a bigamist marriage with a white woman citizen. They don’t live together, but have a child. The black man leaves them and goes to Harvard University and later moves back to Africa. The mother eventually marries a man from another country, and takes her child with her for 4 years, and then sends him back to the USA to be raised by her grandparents. Is he a natural born citizen?”

Their minds would have exploded - or George would have beaten you up for asking such a stupid question at his dinner table.

The founders were wise and worldly men. I don’t think they would have found it so insane. After all, Alexander Hamilton was illegitimate, and rose high in the early administrations.

In fact, the Ark Court placed so much weight on the fact that Wong Kim Ark's alien parents were legally and permanently domiciled in the United States, permanent legal residents of the United States, and even engaged in their life's business in the United States, one could argue the Court viewed the parents almost as de facto citizens. This de facto citizenship status of Wong Kim Ark's alien parents, plus his birth in the United States -- as well as his own personal ongoing, continuous and permanent ties to the United States -- all formed the basis for the Supreme Court recognizing Wong Kim Ark as a natural-born citizen.

Mr Rogers should have actually read the Wong Kim Ark decision before writing an article on it because nowhere in there does the Court say that he is a natural born citizen.

Interesting argument that for someone to be ‘natural born’, their parents must be ‘in amnity’ with the U.S. Government, which means not just a non enemy, but a friend of the U.S. So this could be another argument against Natural Born Obama — his mother was no friend of the U.S.

Exactly. Wong Kim Ark petitioned the SC as a NATIVE born citizen, not a natural born one.
