Elena Kagan chosen as Supreme Court nominee, NBC reports [Updated]

President Obama has picked Solicitor General Elena Kagan as his nominee for the U.S. Supreme Court, NBC News reported Sunday, choosing a relative moderate who may still face questions from Republican Senators on gays in the military.

White House officials did not immediately respond to a request for confirmation of the NBC report, which gave no source for the information.

[Updated 8:10 p.m.: The Associated Press has also reported Kagan's nomination, citing a source who spoke on condition of anonymity because the decision had not been made public. Obama will announce his choice at 10 a.m. Monday in the East Room of the White House, says the AP.]

The spineless Repubs in the Senate won’t even raise an eyebrow, much less a single word of objection to this vastly UN-qualified, massively socialist, radical lesbian activist.

Need Affirmative-Action for white protestants to even the playing field.

If you don’t have power you can’t be considered a racist. So WASPs can start playing the race card now???

Constitution Theory -— In her testimony during her confirmation for solicitor general, Elena Kagan wrote: “I think a judge should try to the greatest extent possible to separate constitutional interpretation from his or her own values and beliefs. In order to accomplish this result, the judge should look to constitutional text, history, structure and precedent. Relating these views to the position for which I am nominated, I think these kinds of arguments also are most successful in advocacy before the courts in constitutional cases. ... The Constitution generally imposes limitations on government rather than establishes affirmative rights and thus has what might be thought of as a libertarian slant. I fully accept this traditional understanding, and if I am confirmed as solicitor general, I would expect to make arguments consistent with it.”

Judicial Activism -— In Ms. Kagan’s written responses to Senate questions during her confirmation for solicitor general, she disagreed with the view that the courts should take the lead in creating a more just society.

Defining Combatants -— During her confirmation hearing for solicitor general, Ms. Kagan agreed with a questioner that someone suspected of helping to finance Al Qaeda should be subject to battlefield law — indefinite detention without a trial — even if he were captured in a place like the Philippines rather than in a physical battle zone.

They wants someone on their side of the court who can stand up to Roberts, to bring Kennedy to their side. Kagan is smart, but she is an academic rather than a jurist. Roberts has been playing this game a lot longer. Obama, though, will get a third choice. Ginsberg cannot last much longer. Probably another woman , but maybe a pol.

I did not know this, and I will keep this in mind as the 'high' court rules on our Constitution, given who our Founders were generically speaking in 'religious' denominational terms.
