Kagan: A question of boundaries

When Elena Kagan was nominated, I figured that the media would treat the whispering about her personal life rather gingerly, if at all.

It's been about as subtle as a sledgehammer.

In fact, with friends now emerging to say that the solicitor general of the United States is not gay, a larger debate has taken root over whether such questions should be asked at all.

Inevitably, liberal acquaintances of mine have compared questions about Kagan’s “orientation” to questions about race, which of course were just fine when the “wise Latina” was up for confirmation. And they’d have a point, if racial minorities consistently (that is, not just on the Left) defined themselves in opposition to whites, and consistently agitated for anti-white laws and interpretations. Inconveniently, they don’t, as Justice Thomas and others have demonstrated. Homosexual activists, by contrasts, define both their cause and their very being as anti-heterosexual, and they and their enablers/handlers consider it a badge of honor to remove “straight privilege” from American law and society. Kagan has proven herself all too willing to continue that pattern, and whether or not she’s an active lesbian, it is completely legitimate to question her ability to rule fairly in cases involving marriage or sexuality.

Yeah, she’s gay. That’s supposed to give her cover, and we’re not supposed to talk about that—or her.
Just like our three-eighths A-rab POTUS is considered “black” and thus we can’t talk or think about him or his real ethnicity either.
