Obama ramps up criticism of Ariz. immigration law

WASHINGTON (AP) - President Barack Obama stepped up his criticism of Arizona's controversial immigration law Wednesday, calling it "misdirected" and warning that it has the potential to be applied in a discriminatory fashion.

Speaking at a joint news conference with Mexico's President Felipe Calderon, Obama called for overhauling the nation's immigration laws and said that can't be done unless Republicans support it.

"We can do so if we create a safer border, a border that will unite us instead of dividing us, uniting our people," Calderon said. "We can do so with a community that will promote a dignified life in an orderly way for both our countries."

The controversy over the Arizona law, which would make it a state crime to be in the country illegally, hung over Calderon's visit. Both leaders oppose the law, with Obama directing the Justice Department to review it for possible civil rights violations, and Calderon's government issuing a travel warning for Arizona, out of concern that Mexicans face an adverse political environment there.

Calderon made good on his pledge to take up the immigration issue during his meetings with Obama. He said the Arizona law criminalized migration and could encourage discrimination. He also called for the U.S. and Mexico to work together to solve the complex, politically sensitive immigration issue.

Let’s see, I’m just an ordinary citizen who was interested in reading the law, so I did some hard work, typed in “SB1070 text” on Google, and lo and behold, the pdf file pops right up!
I know that may be very complicated for some if these politicians, but hey, aren’t they so much smarter and better than us lowly citizens? So, if they haven’t read the law, what’s their excuse?

If he gets amnesty the next step will be that they have the same rights and natural born citizens which will pave the way for him to claim that even though he is not a natural born citizen it was legal for him to serve POTUS.

Hey big important president guys, how ‘bout the USA just adopt Mexico’s policy toward illegal immigrants? That should solve the whole mess, right? We’d all be equal that way. We could call it a Global Immigration Standard.

If the inept federal government would do it's job to process immigrants in a timely and responsible manner, and if the federal government would do its job guarding the borders, and if the federal government would do its job prosecuting employers hiring illegal aliens..... then "immigration reform" would not be necessary.

So, how is it any different than the federal law? It was already a federal crime for improper entry by alien. SB1070 says police cannot solely consider race, color or national origin.

Is federal immigration law different from Arizona's new law?

Section 287(g) of the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA) of 1996 is a program that deputizes State and local authorities to enforce immigration matters via a Memorandum of Agreement with the Department of Homeland Security. Under this agreement, the ICE trains State enforcement agents on how to handle immigration issues.

Last July, Janet Napolitano "standardized" the MOA's to "promote consistency" in the manner that partner States enforced immigration law, and expanded the program by adding eleven new agreements with law enforcement agencies around the country, bringing the total number of existing MOA's to seventeen.

Arizona entered into a 287(g) MOA with the DHS in 2006.

According to the DHS press released linked above, Napolitano's "standardization" will "improve" a program designed to "support local efforts to protect public safety by giving law enforcement the tools to identify and remove dangerous criminal aliens."

Critics of the new, standardized MOA's point out that it weakens the act by directing partner agencies to only investigate immigration status when the individual in question has committed a serious or violent crime, rather than simply committing a crime while in the country illegally.

Arizona's much-maligned SB1070 is being attacked by Obama administration officials, but the law itself is little more than internal clarification on how State and local government agencies should administer Arizona's immigration law enforcement abilities as agreed upon with the DHS under the existing MOA pertaining to section 287(g). The ability to make immigration inquiries, and the INS's obligation to respond to those inquiries are additionally clearly detailed in 8 USC s 1373.

Reading all that, the administration's constant attacks on SB1070 are suspect at best, disturbing at worst. They expand the participation of non-Federal law enforcement agencies around the US in the enforcement of immigration law, while weakening the act itself by restricting enforcement to illegal aliens who have committed violent or serious crimes, not just committed a crime while being in the country illegally. Then they attack a State that is legally able (under a program that they themselves are expanding) for discharging their duties and enforcement powers under Federal Law.

Either this administration is too inept to understand existing law, or they don't care to understand existing law, and would instead rather incite racial strife and class warfare between the people of the United States to a degree that borders treason.

Posted earlier this evening are citations from California Penal Code that says the same thing as the Arizona law. Where is the outrage over that???

That is because California, like Arizona, signed a 287(g) MOA prior to 2006.

North Korea is attacking South Korea, and our Moron-in-Chief is spending his time whining about a new state law that the majority of his constituents agree with.

Weird times. I wish I could flash forward to see how he wins reelection in 2012, if we even have an election. This guy isn’t going to just give up his power, I guarantee that much.
