I suppose the prosecutor's office had little choice here, but still...it's these sorts of cases that make one lose faith in the justice system.

Only because they're stupid. The witness(s) say the bike did not cross the double yellow. The point of impact (the right driver side wheel well) is consistent with the van moving back into the correct lane at the time of impact. The van drivers BAC and crack use is consistent with wreckless endangerment and negligent homicide.

They can only work with the evidence gathered. Useless evidence is worthless. I prefer a law that if you're impaired you are guilty of everything that follow.
