I don’t think you are nitpicking. It is really something to say Kagan took money from OBL if in fact she took it from his brother, father, cousin, whoever.

I rather doubt Osama was donating to Harvard, before or after 9/11.

But if they’ve got something to back this up, well, if they did you’d think that would be the lead sentence.
