There is no way that stands in a court of law. If the law of the state is no gay marriage, any company showing favoritism toward said group is violating the EOE statues, and thus, up for pending litigation, potentially from married couples.

The precedent is another slippery slope. If allowed to stand, employees could sue for equal protection if they're smokers, over weight, etc.
