I’m no constitutional lawyer but reading through it, the DOJ is making arguments that are dangerous to the Leftist agenda. Dangerous because they are the basis for the progressive agenda and if the Supreme Court decides against them, the Supreme court will have to define the reason and that reason could overturn a prior (leftist) precedent.

Obama is leading with his chin on this one.

It seems that making the constitutionality of it an afterthought,rather than a foundation principle, puts them out on a limb; for Obama to have taken office by swearing to uphold the Constitution, then have to scramble like this, seems the clearest form of malfeasance( I’m sure he’s not the first, but this is a big piece of pie). Maybe we can get back to using the principles of the Constitution organically as we become reacquainted with it
