| It clarifies that the special election is distinct from the 2010 general election -- clearing the way for Rep. Shelley Moore Capito, R-W.Va. to run for both the Senate seat and for re-election to her House seat, should she choose that option.
Senate Minority Leader Mike Hall, R-Putnam, said the provision applies to any number of candidates who won primary elections in May and are already locked in as candidates on the November general election ballot -- who otherwise would be prevented from running for the U.S. Senate seat.
"There are probably more than 400 qualified candidates who can't run for Senate, because they are already on the (2010) ballot," Hall said of the current law.

This is a tough call. Shelley Moore Capito may be the only Republican who has any chance at all of defeating Joe Manchin, who has been criticized for his interim appointment. Also, what will the legislature do with the 2012 redistricting?

Excellent. I was concerned that if Capito ran in the special election for Senate then she couldn’t run for the House seat. I would love to see her as a senator.
Not tough at all. The new law allows her to run for both at the same time.
Indeed. If wouldn’t look good running for both but since her opponent for the house seat is a nobody with no chance she’d have nothing to lose.
So, they did the LBJ Texas Statute trick eh? Pretty smart. Hope it bites them hard. I’d love to see a bitter primary in the Dems.
And a nice spirited one in the GOP.
