A Houston man expected to be freed today after being imprisoned 27 years for a rape he did not commit will have to wait one more day after reacting "emotionally" to the reality of his release this morning.
Bob Wicoff, an attorney for Michael Anthony Green, said his client was angry and would need another day to compose himself before having a bond set while the Texas Court of Criminal Appeal rules on his actual innocence.
"He was upset," Wicoff said. "Hopefully he'll be fine tomorrow."
Green was expected to be granted a personal recognizance bond by visiting state District Judge Mike Wilkinson this morning. He was not brought into the courtroom, but loud shouting could be heard from behind the door to the court's holdover cell.
Wicoff said the shouting was Green.
"This has been a gross perversion of justice and he's a smart guy and he knows it," Wicoff said. "He's angry."
The release was the next step in proceedings to declare Green actually innocent of a 1983 sexual assault.

I hope this man sues the living daylights out of those that convicted him.
And those who are keeping falsely imprisoned one more day. It isn’t illegal to be angry.
The saddest part is they know who did the rape through DNA evidence but the statute of limitations has expired so they cannot be charged.
I’ve got a sneaking suspicion that I’d not be pleased getting released after 27 years for a crime I’d not committed, although I suspect that I’d just shut up.
Then I’d hunt down and kill everybody who had any part in the episode, including judge, jury, district attorney, and especially the cops who started the mess out.
I’m not a forgiving person, and I’d be in a much worse mood having half of my life taken from me.

27 years! What does that do to an innocent person? I hope he doesn’t end up back in jail.
I feel for the guy, but they’re releasing a time bomb on soceity. God bless him, he’ll need all the help he can get.
I doubt you would be a suspect in those murders too.
Justice needs to be just. Nothing can give this man back 27 years of life.
How about the prosecutor finishes out his prison term.
I think being upset and vocal is justifiable in this case!
One is led to wonder what horrors were inflicted upon him by other inmates or guard who hold “sex offenders” in contempt.

I believe I’d go after the rape “victim” first, the one who falsely accused the poor bastard.
The government and political class rob individuals of their lives on a regular basis then expects to be exempt, so they can do as they damn well please!
Might as well finish what they started.
In many rape cases, the victim never identifies the person who raped her because they didn’t get a good look at them.
Evidence needs to be properly vetted, verified and beyond a reasonable doubt for a conviction to take place. Someone, or a large group of someones (i.e. the jury), did not take that seriously when they convicted him.
It’s not the victim of the rape who is responsible 99% of the time.
Understandable sentiments, but you should heed the words of Montresor in Poe's The Cask of Amontillado: "A wrong is unredressed when vengeance overtakes it redressor."
The “rape” victim already got her pound of flesh. Does it really matter to her that it was the wrong guy?
