A SERIOUSLY ill toddler whose parents went to court to lift a hospital's effective death sentence is now defying the odds.
The parents of Child X, 3, were told his condition was terminal, and the hospital wanted to stop the kidney dialysis keeping him alive.
But they refused to give up hope, and sought an urgent injunction from the Family Court while they awaited a second medical opinion.
An order preventing the hospital from stopping dialysis was granted on June 28.
The boy has since shown such remarkable improvement his parents now hope to be able to take him home.
The Herald Sun cannot reveal the child's identity or the hospital in which he is being treated.
The parents, who spoke to the Herald Sun through their lawyers this week, say their only child is a happy boy and always in good spirits, despite having to endure three dialysis sessions a week.
The boy has had medical problems since birth, and was admitted to the hospital with septicaemia in April.
The next day, his kidneys failed and he was moved to intensive care.
The hospital diagnosed his condition as terminal, and decided dialysis should stop, as his other medical problems may not allow him to enjoy "quality of life".
But his parents always believed he would get better.
A retired judge referred them to Nicholes Family Lawyers, and barristers Andrew Robinson and Noel Ackman, QC, acted for them without fee.
Justice Paul Cronin, who heard brief evidence from the boy's father, granted a temporary injunction pending a second opinion and argument about whether he had the power to make such an order.

Exactly.
Lowest common denominator “health care”.
You know, I don’t trust the newspeak. When I was a younger man, we referred to physicians as doctors or to their profession as “medicine”, including the nurses.
Somehow, they have now become “health care providers”.
This is newspeak intended to reduce expectations from medical professionals as the affirmative action underachievers take dominance and the quality of medical care is reduced to its lowest common denominator, which is what you can expect from “health care.”
It isn’t “care” at all.
It is negligence, incompetence, ignorance, malpractice, and malfeasance.
The doctors will just be employees of the government, like teachers. They may even become unionized, and we can expect the same level of quality as we do from all the unionized government workers.
I am a Christian, and a realist. If God wants you alive, so be it! He will prevail. But, I'm not for spending these dollars to keep people artificially alive. Let God be the arbiter!
If Obamacare results in the harm or death of my child, my response will not be pretty. I’ll just leave it at that.
So the poor should just die.
“Do Not Resuscitate”
That sign should be posted on every door at 1600 PA Ave
Should tax dollars pay for health care?
everybody will die!
They receive that exact same care as any body else in our society, as they should. A child who is sick has no choice as to the financial viability of his parents. The parents of many children are driven into despair and often times bankruptcy due to the inability to work, the travel, and expenses related top getting the best care for their sick children.
Many parents travel hundreds or even thousands of miles to get the specialized attention for their children. Often times they lose their jobs and homes because of the time and money they must devote to their sick children. The divorce rate among couples with sick children is very high because the character involved in maintaining a relationship wholly devoted to ones child and family is lacking in many couples. It is a compounding of the trajedy.
Regardless, many of the children are cured or at least are able to lead valuable and important lives filled with accomplishment and love. These sick children give a great deal more to their parent's and to society as a whole than they mere dollar value that they take for their care.
I highly doubt that you are truly a christian. How many people do you know that can afford hundreds of thousands of dollars in medical care for one of their children? You would make a good little bureaucrat the new board of services in Obamacre. If you have never had a chronic or fatally sick child you are simply being an jerk with your opinion.
I would spend my last dime on my children. I won't ask for yours!
We think alike on this subject.
My best friend is a VERY black west African from Burkina Faso. Together, we have funded three orphanages/medical units. He and I met in DC back in the 90’s.
Using and leveraging my small contributions, we first bought equipment for one of his :”aunts”, a midwife. At the time, she was supporting more than 80 children born to dying AIDS mothers. Most did NOT have AIDS, but needed nourishment, love, and education. Since then we have done it twice more. I buy used stuff from the gum’t at ridiculous low prices, and ship containers with anything else we can scrounge. I use my feet and my tongue. Dollars only go so far!
>>But, I’m not for spending these dollars to keep people artificially alive. Let God be the arbiter! <<
They don’t have much of a choice in Brittan. The gov’t owns the healthcare. The parents are taxed to pay already so by your logic, the parents have already paid for their son’s care.
Then it was denied.
Is that right?
This article is actually from Australia.
We do have universally funded health care here, paid for by a specific levy on our taxes - you do not have a choice as to whether you pay or not, but that levy is reduced if you have private health insurance.
While I am ideologically opposed to public health care, the system does actually work pretty well here. And you do have every right to go private and pay for your own care (and there are advantages to doing so) if that is what you want.

Funny, how the kidneys failed the day after he got to the hospital, but once there was a Big Stink and a lot of people watching he got better. Makes you think.”
There is no RIGHT to being healthy. There is no RIGHT to using dollars from someone you don't even know... or who could care less about you. It's just about "feelings", not faith!
Grow up!
If I am not mistaken, many of those He took interest in where the deformed, the deaf , the blind, and the lame. It wasn't that long ago that people who had disabilities where thought to have brought them on themselves. Christ helped to dispel this notion. He showed that He and His Father had a special love for the afflicted.
You have a special love for yourself, and none for the less fortunate.
“’Let them eat cake’ they can have as much medical attention as they can afford and no more. These children where not smart enough to be born wealthy. What where they thinking getting sick?”
If you happen to tip over in your Kayak and strike your head and need specialized medical help that exceeds the limits of your insurance, I hope that society treats you and yours with more respect and sympathy than you show others. I speak from experience. My wife and I have a special needs child. We have been very fortunate that we not only live in Cleveland, a city with 2 of the Worlds best hospital systems, but also that we have good insurance through my wifes employer. None the less, my working hours been cut back severely in order to care for our son, as a commissioned sales person my income has been cut dramatically. We have also spent tens of thousands of dollars on deductibles and co-payments as well as giving up our vacations and PTO's to spend time with him in the hospital. We have also given up nights out, movies, dinners, new cars, golf, sporting events and assorted other trappings of upper middle class life that we had been accustomed to and had worked so hard to achieve. Yet we persevered and our son has improved. He brings us as much or more joy than any of our other children. He also brings us more grief, despair and frustration than the others combined. We have not relied on ANY help from the government, but we have met many people who have had to rely on programs that are funded through tax dollars. What exactly are they supposed to do, take their children home to die. Nice Christian attitude! If we exceed the levels of our insurance, they have already paid over $1,000,000. We too will not hesitate to sell our home , our cars, cash in our retirement, and YES apply for any and all available help from any organization or government entity that will help to keep our son alive and help him to thrive. You have no concept of what you are saying. You are simply a jabbering fool. If your child was sick you would do the same. If not, than you are not much of a person, much less a christian.
