Court Overturns Hazletown, Pa., Anti-Immigration Law

A federal appeals court struck down today a Hazleton, Pa., ordinance that criminalized anyone who rented to or hired an illegal immigrant. The ordinance was a precursor to Arizona’s SB 1070 immigration law and other copy-cat anti-immigration legislation, and may signal what is to come for laws accused of preempting federal immigration authority.

Hazleton passed its ordinance in 2006. It was considered one of the toughest laws against illegal immigration at the time. The ACLU, along with other rights groups, filed a suit on behalf of the city’s landowners, business owners and residents, and the law was found unconstitutional by a federal court in 2007. In his decision, Judge James M. Munley wrote that the 14th Amendment applies to everyone in the U.S., not just legal residents.

The city of Hazleton appealed that ruling to the 3rd Circuit Court of Appeals, which today agreed the city’s law was unconstitutional because it preempts federal immigration law:

I am sick and tired of appointed judges ruling on laws which are not even close to violating the US Constitution. The judiciary is making laws from the bench. Their power needs to be severely curtailed.

Until you fight them in court it is the law of the land. The founders would have been one of the judges, and nonsense would never be tolerated.

The courts can go to hell....they only rule against Americans when defending themselves against Illegal Alienism.

Wonder if they, the Anti-American federal courts, rule the same way when some liberal city declares themselves a “sanctuary city”?

Illegal Alien Amnesty is Anti-American Bigotry. If you are not willing to deport 100% of all Illegal Aliens, you support Amnesty. It’s time to get tough, or get out of the way.

I wonder if our Founding Fathers had any idea that the Constitution they so carefully crafted would apply to ALL people of the world, not just US citizens.

A resounding win in November will help in many areas but I don’t see illegal immigration issues being one of them or taking on the issue of our horrible public education system. One of our Texas Reps spoke with pride of their idea to have drones “on patrol” and stated they could “even tell the difference between a poor family trying to cross and a vehicle that might be running drugs”. I would love to see Sheriff Joe as head of Homeland Security.

These stories are tiresome; it is obvious the government is the enemy of the American people (and not just the current president; the previous wasn’t much help either). Hopefully a few brutal winters will send these invaders back south of the Rio Grande.
