I know the purpose of the act but what is the consequence of not getting a waiver? The question in my mind is whether the failure to get a waiver means ballots cannot be sent to the armed forces, or whether it just creates a right of action against the state by soldiers or candidates or the DOJ. I would hope the soldiers can vote either way but it is unclear to me. If, by withholding the waiver, the DOJ can prohibit ballots from even going to soldiers, then granting the waiver would be good because, even if the time is short, they have a right to vote.

There is one problem with this law, it is that a few states hold their primaries a week or so before or after the 45 day limit day. Thus it is not possible for the states to send a final ballot to soldiers 45 days before the november election date, because the primary elections have not been held, selecting who will be on the November ballot. Fortunately for me, during my military years, Indiana had and still has its primary voting in May. This year Maryland has its primary on Sep 14, thus cutting the 45 day limit very close.

Holder also had the DOJ put up a perfunctory defense of "don't ask, don't tell" in the Log Cabin vs. USA case, to make it easier for the Clinton-appointed judge to decide that a law passed 17 years ago by Congress could be tossed out. A payoff to a part of Obama's political base.
