As usual, journalists screwed up the story. Some of the headlines say a tower collapsed. In reality, it appears that a 50-foot hydraulic scissor lift blew over in 50 mi/h winds. That is twice the wind recommended for their safe use.
'Collapse' and 'blew over' certainly are two different things. The former indicates equipment failure. The latter indicates use in unsafe conditions.

If no one held a gun to his head, what’s there to sue about?
Absolutely. It's pure stupidity and a lack of common sense to be up in any kind of lift in windy weather. There's probably warning labels plastered all over it.
It’s sad, but damn. At some point you have to look at the situation and say “hell with that, I’m not going up in these winds”.
