Interesting thoughts. I hope the great defunding starts, because ti can't be repealed until 2012.

Nice to see the opposition lining up the ducks to be shot at.

With due respect to The Great One, the relevant portion of the article is the paragraphs immediately following what he quoted that describes how “defunding” of the ACA can be done.

The real question is: Do the Republicans have the cojones to do it?

I hope they do.

The more that is known about this monstrosity, the less popular it will be. It's a winning issue if they have the fortitude to stick with it. Most of the members of the sixty plus seat pick-up are determined to do it, and a lot of those that were already there are as well.

Defund the entire Federal government.

States invoke their 10th amendment rights and tell their citizens to stop paying Federal Income Tax.

States make it illegal for companies to take Federal Income Tax out of employee wages.

States then tax their own citizens the appropriate amount to pay for the only things the Constitution allows the Feds to do - protect the borders and insure free trade across state lines - and then pass that along to the Feds. (Divide what border protection & trade regulation costs by the total number of US citizens then multiply that number by the states population.)

If the Federal government still refuses to protect our borders, then the states can keep that money and do it themselves.

Hey! AS long as WE stay on top of their butts, and make them do our bidding simply by staying on their butts, they’ll do what we want them to do. They’ll have us to blame. That’s how things are today thanks to the leftists over the years. Always needing someone, or something to blame to cover their butts.

We cover the RINO’s, and they will do as they are told. We won’t need to worry about the conservatives.

I hope that makes sense.

It makes great sense, RINO’s need a strict parent to control and discipline them. And in some cases they would really enjoy it too. Its a win win situation.

from the NEJM article:
http://www.nejm.org/doi/pdf/10.1056/NEJMp1011213

“Perhaps the more likely — and in some ways more troubling — possibility is that the effort to repeal the bill will not succeed, but the tactic of crippling implementation will. The nation would then be left with zombie legislation, a program that lives on but works badly, consisting of poorly funded and understaffed state health exchanges that cannot bring needed improvements to the individual and smallgroup insurance markets, clumsily administered subsidies that lead to needless resentment and confusion, and mandates that are capriciously enforced.
Such an outcome would trouble ACA opponents: their goal is repeal. It would trouble ACA supporters: they want the law to work. But it should terrify everyone. The strategy of consciously undermining a law that has been enacted by Congress and signed by the president might conceivably be politically fruitful in the short term, but as a style of government it is a recipe for a dysfunctional and failed republic.”

What they should have said is that the law itself terrifies everyone.

The Wall Street Journal, Nov. 3 issue, page A25, has a column by Holman Jenkins with the title "The GOP Can Outsmart ObamaCare"...worth a read.

Nice post, and a nice reference to have (the NEJM article, here), especially to use with those people who never believe anything unless it is published somewhere "reputable."

Another route...

Isn’t it true that there is no ‘severability’ written into that monstrosity health care bill?

Since so many legislators never READ the bill, NOW, if constitutional experts can find JUST ONE UNCONSTITUTIONAL part, then the WHOLE BILL could be tossed by SCOTUS. Right?

OR...

Reformers could attack or weaken the ‘commerce clause’ that lets the federal government take over or regulate intrastate businesses like health insurance or doctors.

Health care insurance NEVER crossed state lines before, so technically it should have been off-limits for Hussein to get involved in any way!

Reformers SHOULD beef up Federalism (more power to the states, less power to D.C.)

“...if constitutional experts can find JUST ONE UNCONSTITUTIONAL part...”

Mandating the populace to purchase...I believe that is unconstitutional.

“Reformers could attack or weaken the ‘commerce clause’ that lets the federal government take over or regulate intrastate businesses...”

I’ve always thought that should have been specified by the founders in the Constitution as an arbiter’s position for the Fed, NOT as a regulator of Commerce.

” Health care insurance NEVER crossed state lines before....”

It was for a reason. I can’t remember specifically why it was T. Kennedy was reluctant, or ? to allow the insurance to travel State to State. I say T. Kennedy, because Socialized Medicine was his nightmare for us since the ‘60’s.

“(more power to the states, less power to D.C.)”

The way it was intended to be by the founders I believe.

I see the Fed as the hired management company for the purpose of maintaining the grounds for the Union to function in a clean environment, and that isn’t environmentalism that I’m promoting by that statement.

The cat is already out of the bag, and has been since 1942.

"Wickard thus establishes that Congress can regulate purely intrastate activity that is not itself “commercial,” in that it is not produced for sale, if it concludes that failure to regulate that class of activity would undercut the regulation of the interstate market in that commodity."

This means that the federal government, according to the US Supreme Court, can tell what the hell to do with wheat that you personally grow on your own property for the sole purpose of feeding to your own chickens.

Obama says he's willing to tweak healthcare ...Tweak? The O/care monster needs a bulldozer, and 100 construction musclemen armed with power saws and jack hammers.......that's just for beginners.

BETTER MUCH BETTER Cong Mike PENCE: “We will repeal OBamacare, lock, stock and barrel”....we will dig it out of the ground....every branch and root."

BETTER MOVE FAST REPUBS: The whole thing is a "Marxist structure" purposefully designed to change America. Ohaha’s got BIG plans, much much BIGGER PLANS.

O's healthcare nightmare.

The Chart that Will Infuriate Taxpayers: ........diligent personnel could not fit all of O'Care's new law’s boards, commissions, mandates, and other elements on this chart. So they created “bundles of bureaucracy.” Seven collective symbols respectively represent clusters of four loan repayment and forgiveness programs, four other new regulatory programs, 17 insurance mandates, 19 special-interest provisions, 22 other new bureaucracies, 26 other new demonstration and pilot programs, and 59 other new grant programs.....

These 151 additional items within Obamacare do not appear individually on this diagram. As Representative Brady explains, “If we included all of these units, this chart (above) would be three times larger.”

========================================================

O/CARE will transfer to the Obama Admin, authority in a number of ways over the lives of Americans, and their businesses. Once govt gets control of medical care, all the defining, controlling features of socialist govt can be introduced, one by one. E-v-e-r-y-thing Americans do is related to health.

O/CARE Page 58 and 59: The government will have real-time access to an individual’s bank account and will have the authority to make electronic fund transfers from those accounts.

Socialized health care is impossible without seizing private medical records----BUT the 4th Amendment prohibits seizure without warrants. He'll do it anyway.
