Political Judges (Thomas Sowell)
Jewish World Review ^ | November 9, 2010 | Thomas Sowell

Results of the recent elections showed that growing numbers of Americans are fed up with "public servants" who act as if they are public masters. This went beyond the usual objections to particular policies. It was the fact that policies were crammed down our throats, whether we liked them or not. In fact, laws were passed so fast that nobody had time to read them.

Whether these policies were good, bad or indifferent, the way they were imposed represented a more fundamental threat to the very principles of a self-governing people established by the Constitution of the United States.

Arrogant politicians who do this are dismantling the Constitution piecemeal-- which is to say, they are dismantling America.

The voters struck back, as they had to, if we are to keep the freedoms that define this country. The Constitution cannot protect us unless we protect the Constitution, by getting rid of those who circumvent it or disregard it.

The same thing applies to judges. The runaway arrogance that politicians get when they have huge majorities in Congress is a more or less common arrogance among federal judges with lifetime tenure or state judges who are seldom defeated in elections to confirm their appointments to the bench.

It was a surprise to many-- and a shock to media liberals-- when three judges on Iowa's Supreme Court were voted off that court in the same recent elections in which a lot...

WOW! What a stupid header you have there... Can you actually say Constitutional Judges with the same breath. Geez, things are really getting bad when the Constitutional beliefs and the results are questioned. Don’t know where this Country is heading but is is NOT good!

Giving judges appointments for life turns out to not be such a great idea when the judges have no regard for the law or the Constitution and getting rid of these corrupt judges ought to be much easier.

What amazes me (besides the consistency with which Sowell “gets it”) is how far the American people have to be pushed before they fight back.

Unfortunately very true! Seems that the best argument is to limit their terms to about 8 years or so to prevent them being influenced by political events (Elections are a problem, but life-time is worse). I only hope that this happens in my lifetime (not hopeful..)..

We tried our hardest to get 4 supreme court justices thrown off the bench but there were just to many imbeciles out there to get the job done!

The Constitution cannot protect us unless we protect the Constitution, unless we enforce the Constitution.

I would extend the term to 10 years to prevent a single president from loading the entire bench.

Yes, the term is debatable... That is about the only thing that I would agree on.

I agree...It’s too bad there’s not term limits on federal judges. If there was one of 8 years or so and they were selected for the next higher court that term could begin anew. It might work to the benefit of the people in that the activists such as some we have now wouldn’t rise higher.

These people are the poster children of abuse. Dr. Sowell is right. It is long overdue to rid ourselves of them.

It’s too bad there’s not term limits on federal judges.

Well with the exception of the USSC there is nothing in the Constitution that says there isn’t.

Yes, don’t forget that the Constitution CAN be changed by an amendment! It is a hard process, but when things get out of hand, it will be done! Today, people are waking up to the destruction of America and they might finally awake to changing the Constitution.

If not now, what catastrophic event will change the voters thinking? I’m afraid that the awakening will occur too late to make a difference...
