NEW YORK, November 10, 2010 (LifeSiteNews.com) – Two more lawsuits have been launched against the federal Defense of Marriage Act (DOMA), bringing even more legal pressure to bear on the beleaguered marriage law.
The Gay & Lesbian Advocates and Defenders (GLAD) filed a lawsuit in U.S. District Court in Hartford, Connecticut on behalf of three homosexual couples and one widower who were denied federal spousal benefits.
“DOMA must fall,” said Mary L. Bonauto, GLAD’s Civil Rights Project Director. Bonauto contended that the intent of passing DOMA in 1996 “was to harm gay people and same-sex families with this law, and sadly, it has succeeded.”
“Married gay and lesbian couples fall through the federal safety nets that exist for other married people,” she said.
The case is Pedersen et al. v. Office of Personnel Management, and is the second front GLAD has opened up against DOMA.
Earlier this summer a U.S. District Judge in Massachusetts ruled unconstitutional Section 3 of DOMA, which defines marriage for federal purposes as the legal union of a man and a woman. Judge Joseph Tauro in Boston said DOMA violates the principle of equal protection guaranteed in the Fifth Amendment of the U.S. Constitution and “encroaches upon the firmly entrenched province of the state,” violating the Tenth Amendment.
The Obama Justice Department has appealed the ruling.
The American Civil Liberties Union is also attacking DOMA on a similar front, contending that a New York homosexual couple married in Canada had their rights violated, because inheritance laws did not apply to them under DOMA.
The case Windsor v. United States of America complains that Edith “Edie” Windsor had to pay significant estate taxes on the property she inherited from her deceased partner, Thea Spyer, because DOMA meant the federal government did not have to recognize their Canadian marriage.
The ACLU argues the federal government ought to recognize Windsor as deserving of the same tax treatment as married heterosexual couples on the basis that the state of New York recognized the Canadian marriage as valid in state law.
Although President Barack Obama says he supports a repeal of DOMA, he has advocated for a legislative solution in Congress. This has chagrined many of his supporters who view the federal courts as the fastest and surest way to repeal DOMA.

The state has recognized marriage for untold centuries. That insures the protection of women and children, legitimacy of heirs, and since the family is the foundation of human civilization, this state recognition of marriage is essential.
Saying “get the gov out of marriage” is like saying - “this patient is sick, let’s kill him!”

Even the woman turned against the natural way to have sex and instead indulged in sex with each other. And the men, instead of having normal sexual relations with women, burned with lust for each other. Men did shameful things with other men, and as a result of this sin, they suffered within themselves the penalty they deserved.
Since they thought it foolishness to acknowledge God, He abandoned them to their foolish thinking and let them do things that should never be done. Their lives became full of every kind of wickedness, sin, greed, hate, envy, murder, quarreling, deception, malicious behavior, and gossip. They are backstabbers, haters of God, insolent, proud, and boastful.

I know, thanks. What I meant when I said homosexuals already have a right to marry, in the true meaning of marry, just like everyone else.
Look at that homo governor of NJ who resigned. He was married to a woman and had children!
I keep thinking that we can not possible hope for this despicable administration to defend DOMA, at least not vigorously enough to win. It will take state attorneys general, who are overwhelmingly the parties with standing, who must demand the right to fight these nihilistic leftists.
It’s not marriage, it’s really about how marriage gets promoted. A family in which parents of opposite genders share responsibility for the upbringing of a child is the ideal, and so promotion should be to keeping such marriages going without divorce, as well as encouraging faithfulness within the marriage as well. What does it mean to promote the general welfare? That’s an important question, because how that applies to marriage and those in need of charity. I certainly believe that preaching and advertising good moral behavior are what promoting the general welfare mean. That’s my opinion, to say the least. Since living in families with a fractured parentage is correlated with a great deal of the crime and high-risk behavior in a lot of our youth, and does apply to our nation’s general welfare, there is a job to at least promote it’s occurrence and its sustainability, coming from the preamble of the constitution.
And one way to promote marriage (without which there is no human civilization possible) is for the government to stop promoting faggotry as normal and natural with special legal protections. AND to stop rewarding animal style human breeding with AFDC welfare, HUD, food stamps, housing assistance, free meals in public schools, energy assistance and all the entitlements that enable feral humans to breed without marriage and responsibility.
Every normal parent knows that if you reward bad behavior in a child - say give him a hug and a piece of candy every time he lies - guess what! He’ll lie more and more frequently! Sheesh!
