Government Withholds Fort Hood Report

A key intelligence report that could aid accused Fort Hood shooter Major Nidal Hasan's defense was being withheld by the Obama administration, Fox News Channel reported late Friday.

The letter, dated Oct. 19, was sent by the general counsel for the national intelligence director -- the nation’s top intelligence official -- to the chief army prosecutor, Col. Michael Mulligan. It stated that the intelligence review requested by President Obama immediately after the shooting last year “is not reasonably available.”

Robert S. Litt, general counsel for Director of National Intelligence (DNI) James Clapper, cited “highly classified, compartmented and sensitive information originating with a number of different executive branch agencies” as justification for withholding the document on the shooting, which left 13 dead and more than 30 injured.

In what could be a slight to the defense, the letter stated that a review of the material would be complicated, and the DNI letter strongly hinted it would never be produced for Hasan’s defense.

“The document you requested is an interagency joint response," the letter said. "Accordingly, we cannot produce the document [if ever] until after a detailed and time-consuming interagency coordination and consultation regarding the report and the underlying highly sensitive information it contains."

John Galligan, Hasan's defense attorney, said he requested the White House intelligence report nearly a year ago, and it is only now that he was officially told the information would not be available.

Despite repeated requests, Galligan said other documents were also being blocked, including the full accountability review of Hasan’s supervisors at Walter Reed and all the emails exchanged between Hasan and radical Islamic cleric Anwar al Awlaki.

...and the DNI letter strongly hinted it would never be produced for Hasan’s defense.

Parsing that out it says "we are trying to reassure the public that Hassan won't get to use it but we're leaving the back door open so that he can when no one is looking." Of course bringing up the report and saying that "it could be used in Hassan's defense" means that they are handing his defense a reason to call for a mistrial or otherwise scuttle the prosecution.

...the Army may easily punt to the State of Texas. They can take care of him, pronto rather than later.

Can they do that? If so, find me a good ol' Texas hangin' judge. (Shouldn't be too hard.)

Didn't know that fact. I probably heard something regarding him "volunteering" or something to that effect but a "part of his campaign?"

What was he, another "community disorganizer?"

Yes, Hassan will lve on the lap of luxury with a life sentence, with possible parole once he is “rehabilitated.” I wish the military police officers had given him a coup de grace on location, which would have been quite justified in the circumstances.

I would not at all be surprised to see this happen, at least for the civilians (I believe there were 4 or 5 civilians). Even if things go really well, Hasan wouldn't be executed in the military system for another 20-years. Texas could do it a week from next Thursday.

Something for all Americans to keep in mind whenever confronted by these Koranimals in the act of jihad. Or anyone else that is trying to kill you for that matter. If the situation is clear don't give them a second chance to mess with you on the street or in the courts.
