Court: Utah Not Immune From Lawsuit In Bear Attack

I’ve learned its pointless to have arguments about the legal system with people who only think they understand what is going on. for instance you go on and on about jury selection. in this day and age, plaintiffs rarely ask for a jury, they would rather have a judge weigh the case rationally. The defense always asks for a jury, because they can be sure there are a bunch of misguided people like you in the jury pool.

a judge in Utah ruled 4th May 2011 that the campsite ought to have been shut down after it came to light that another camper had been attacked beforehand.

In his ruling U.S. District Judge Dale Kimball said the forest service had a ‘duty’ to warn the Ives family of the earlier attack either verbally, by posting signs on a gate leading in the area or by roping off the specific campsite.

Mr Kimball said it was ‘foreseeable’ that the bear would return to a campsite where it had earlier attacked campers .

The judge also said an off-duty forest service employee was negligent in failing to contact others in the agency that could have determined whether the campsite should be closed.

A forest service employee who discussed campground fees with the family did not tell them about the first attack.

The judge said Utah’s Division of Wildlife Resources should shoulder some responsibility for failing to contact the forest service about its search for the bear.

Bears were **deliberately** reintroduced into the Wasatch Front. What IDIOCY! A major metropolitan area is literally within a day's hiking distance.

Fools! Pioneers eliminated bears for a good reason.
